NWR region finally came out with promotion to the post of Inspectors out of CR vacancies without waiting for new RR. On Friday (16/05/14), 128 employees promoted as Income Tax Inspectors. It is implied that the DPC has been held according to existing recruitment rule.

HOW THE CCIT HAS PASSED SUCH ORDER WITHOUT RECEIVING THE R.R. iF LATER, R.R IS MODIFIED, HOW THESE POSTS WILL GET REGULATED. WHY ALL CCITS ARE NOT MEETING TO IMPLEMENT THE CR POSTS FOR PROMOTION.WHAT IS ITEF DOING. IT IS NOT ACTING PROPERLY. WHEN K K N KUTTY IS PRESENT AT THIS POINT OF TIME, THINGS WILL BE DIFFERENT. IT IS SURPRISING THAT THE BOARD IS KEPT SILENT ON EVERY MATTER AS IF THEY WERE NOT RELATED TO THEM.THIS KIND OF IRRESPONSIBILITY ON THE PART OF THE BOARD WHICH IS THE UPPERMOST BODY IN INCOME TAX IS NOT AN EXPECTED ONE. IT IS COMPLETELY OUT OF CONTROL. THIS IS THE TIME TO WAKE UP AND CONTROL ALL CCITS FROM GIVING THEIR OWN INTERPRETATION ON THE CRUCILA MATTERS SUCH NR PARMAR AND RRS.ITEF IS COMPLETELY OUT OF CONTROL AND THE BOARD HAS NOT CONSULTED WITH ITEF EVEN IN SIMPLE MATTERS. my question to blogger of simple income tax that if you have any information regarding promotion to the grade of inspector in Delhi Region please share this information with followers or readers of yours bloggs.
Promotions are being done at various charges at their own fancy, neutralizing the existence a 'BOARD'. The Board's attitude also is like that. That is why there is nothing uniform in the Income Tax Department. The DoPT's orders are binding to every department. The CBDT has turned down the orders of the DoPT to review the RRs every 5 years and compulsorily on restructuring. Recently the UPSC also condemned the Departments for not reviewing the RRs. Still CBDT is following 1986 RR. As the things are going like this, no need to wait for CBDT's instructions anymore.

I fully endorse the views of Shri KNP. Seeing all these, if anybody doubts whether CADRE RESTRUCTURING in CBDT has been approved or not, he cannot be blamed. Because the entire exercise as such is on the recommendations of Committees and Sub-Committees. Change in RR recommended by one such sub committee is in active consideration. What was the hurry in issuing a conditional promotion order which may (and definitely will) lead to litigations, more so in view of DoPT OM No. AB.14017/61/2008-Estt. (RR) dated 25.03.2014. It seems that the ITEF, not bothering about their lost credibility and grim future, is dancing to the tune of a small pressure group.
The pr. CCIT NWR has taken the good decision as 1. Regular dpc for 13-14 has the same RR as of this supple. DPC
2. The existing RR are still applicable as on date of dpc.

good news! TA is also eligible for promotion to ITI if he/she has completed three years of regular service in MS cadre and has passed the Departmental ITI exams as per existing recruitment rule. So friends congrats! in advance it will happen in all cadre. Have patience! CBDT will definitely do justice to all new comers as they are the future and assets of the department. Vacancies otherwise remains vacant.
As per dopt rules and very decision of Apex courts, as on day of promotion to the R.yr. 2014-15, only option to follow exist RRs of all posts. As so far, no RRs have framed/notified on also 1st April 2014 and RRs have not effected retrospectively. every one knows and accept it.
First I congratulate newly promoted ITIs of Chandigarh. It is really very satisfying order for all TA and steno who have completed 3 years service and have passed ITI exam, because this promotion order clears that old recruitment rule will be followed for promotion to ITI in all regions for the posts of CR. All TA and Steno of all regions are impatiently waiting to the follow the same type of order as the Ld. Pr. Chief, Chandigarh has done. Thanks, Thanks a lot.... to the Ld. Pr. Chief Chandigarh.

Excellent decision. I really appreciate the audacity shown by the CCIT, Chandigarh in issuing the order promoting to the cadre of ITIs without waiting for new RRs. If new RRs are to be applied, they should have given at the time of issue of notification. For example, in the case of state bifurcation of Andhra Pradesh, the Central Government has not even decided as to which city has to be named as 'CAPITAL' for newly divided Andhra Pradesh. But it is clear that the same capital of Hyderabad can be used for 10 more years till the capital city is constructed. Likewise, if new RRs are yet to be prepared, then what is the problem in implementing the CR by following the old RRs. This is high time for CBDT to issue such directions to all the CCITs to follow old RRs in implementing the CR, otherwise new RRs must be released without any further delay. Though new RRs are released, I doubt that many members will approach Courts on change of RRs.

But CCIT NWR didnt give benefit to the Sr. TAs and TAs who have completed 3 yrs of services and qualified the inspectors exam. This promotion is purely biased. His order is passed in hurry wihout waiting for RRs. After restructuring of the department feeder cadre for the promotion of the inspectors is Executive Assistants. Hence firstly promotion to the post of EA should have been taken place. A suite has been filed in the CAT against this promotion order.
No benefit of existing RRs have been allowed to the STAs and TAs in this promotion order. Many of the STAs were not promoted though they have completed 3 yrs service as being TA which is also a feeder cadre in existing RRs.
What is the existing recruitment rules at the time of conducting DPC for Inspector cadre is the only criteria.
If a later receipt of recruitment rules after date of DPC, which was contradictory to the old recruitment rules but of no usage.
The settled law is the existing rules at the time of DPC is only applicable and nothing could be changed in accordance with new rules which come after DPC. This should be kept in mind.

Respected Pr. Chief Commissioner of Income Tax, NWR Chandigarh. we brought to your attention that we engaged in the Income tax office, Amritsar as daily wager since 1997 and afterward. We have made Hundreds requests to the Honble Authorities for casual labour status but no one come forwarded to help us. CBDT, new delhi time to time issue the letters that please send the name s who are performing in daily waiger work in the department also your good office forwarded the same but we are saying with heavy heart the Some Officials of the Income Tax Department, Amritsar are not willing to send our names to CBDT, new Delhi. They have also adjusted their Son's and relatives in casual labour scheme we challenged to those people they have never fulfill the criteria of the casual labour staff. Respected Pr. Chief Commissioner of Income Tax, NWr Chandigarh we are doing demonstration about this "DHAKKESHAHI" at Income Tax Department, Amritsar Since 40 days in the deadly weather. Please look into the matter and directed to the CCIT, Amritsar to take necessary action at our matter.
