DPC for ITO to ACIT for the RY '14-'15 within year end : Chairman

While addressing a meeting organized by ITGOA Delhi Unit, the Chairman CBDT announced that the process for holding DPC for RY 2014-15 has been initiated and assured that DPC should convene within this calendar year itself.
It may be mentioned that Chairman, CBDT is due to retire on October 2014.

Before retirement the Chairman should take a decision on Hyderabad CAT issue. Should be implemented all over the country.

Don't take any serious note on this announcement. Our Chairman has just made a joke on us like his predecessors who have given assurance that CR will be implemented before 31.12.2013, 31.
03.2014 31.05.2014 etc., Even our present Chairman has not fulfilled his assurance on notification of Jurisdiction before 15.09.2014. There is no news about our so called great leaders. What and where they now is a million dollor question?

The judgement of Hyderabad CAT cannot be implemented because the vacancies for all cadres which arise before the date of publication of gazette notification of new recruitment rules are to filled with Old Recruitment Rules and not with the amended rules or draft rules, as the vacancies were arose at the time of Recruitment Rules which were existed in force and the rules are prospective and not retrospective in nature.

If you have any doubt, you can refer to the judgement of the Supreme Court, in their judgement dated 24.3.1983 in Civil Appeal No.2954-55 and 2956-57 of 1980-Y.V. Rangaiah and Ors. Vs J. Sreenivasa Rao and Others, it is held that the vacancies are governed by the Recruitment Rules in force as on the date of occurrence of vacancies, and that the vacancies which occurred prior to the amended rules would be governed by the old rules and not by the amended rules".

If you have any doubt now also, please, seek a legal opinion on this and comment with relevant judgements and OMs.

Now this is apparent that DPCfor 2014-15 for all posts i.e. ITI , Sr.TA & others will be conducted as per old recruitment rule.......

But there is one solution regarding this. New RR can be executed from retrospective effect and if it happens no judgement will be applicable on RY 14-15.

Why consequential promotions in the cadre of ITO is not initiated? It affects seniority. So, it should be done immediately.

See, by the CBDT letter, dated 31.05.2013 in F.No.A-11013/1/2013-Ad.VII, the Joint Secretary to GOI has clearly stated that the additional posts that are to be filled by promotion immediately, without awaiting amendments in the recruitment rules on the basis of Model Recruitment Rules issued by DOPT. Then why can't Hyd CAT judgement can be implemented?

Staff car driver will be made ITI directly in new RR. They will serve notices, will do investigations with self driving govt vehicle or outsourced vehicle. Thanks to new RR

It is only one of the several case laws which say that existing rules are used to fillup vacancies. It is the settled legal position.
