CBDT constitutes "Task Force" to implement Parmar judgement

After nearly four years of the landmark judgement, CBDT constituted Task Force to monitor the implementation of  Parmar Judgement in all 18 zones.
The committee, headed by JS(Admn) will ensure review DPCs, wherever necessary and recast the all India seniority list of ITOs for regular promotion to the post of ACIT in various vacancy year.
The committee will assign responsibility to respective DCIT/JCIT in each zone for conduction review DPCs as and when necessary in a time bound manner of two months and submit report to the Board within three months.

The Pr.CCIT of TN & AP is not at all allowing the Consequential promotions to any cadres on ad-hock basis. Regular promotion of ACIT only will benefit the eligible ITIs for promotion of ITO. The Pr.CCIT of TN & AP also does not seem to be following the decision of the Pr.CCITs of Delhi, West Bengal etc. He is so adamant. The JCA is also afraid of him even to agitate against him. While the situation is like this, the merciless leaders of both ITEF & ITGOA (JCA) are fooling the poor aspirant ITIs of our department.The God will never forgive them.In Tamil Nadu the GSs of both ITEF and ITGOA are doing some politics. It is rumored . That's why the Pr.CCIT of TN & AP is not interested in giving promotion ad-hock basis.

Even in Rajasthan also the consequential effect is not allowing for promotion from ITI to ITO on adhoc basis.

First CBDT should decide the policy regarding adhoc promotion from ITI to ITO and consequential policy regarding Direct Recruitment vacancies (ITI, TA 7 MTS ) to be notified to the SSC for the Current year or i.e. vACANCY YEAR 2016-17 or 2014-15, 2015-16)

The TASK COMMITTEE has instituted by CBDT. In the case of N.R.PARMAR the Hon. Supreme Court clearly state that no discrepancy between notification of vacancy (Vacancy year) to SSC and DPC for promotees.

The seniority of 2014-15 and 2015-16 DR post (consequetial post) cannot be fixed above due to DR persons are availeble for R.Y. 2014-15 and 2015-16.

Let us clarify, justice and give promotion

for Promotion to the post of ITI a very. Crucial decision of Supreme Court in the case of M Nagraj & others dated 19.10.2006 has come in light . In which it is stated that no other than SC or ST may be granted reservation for promotion. Hence it is cleared that 25% reservation for stenographers for promotion to post of ITI is invalid according to the apex court . It may help the helpless SrTAs and OS who lost their promotion due to this 25% reservation of steno cadre.

Its not reservation in promotion, its quota for stenographer cadre which is one of the feeder cadre for IITs. Its very valid legally.

Same thing is said above, the quota should not be treated as reservation, accordingly the unoccupied seats of steno quota can not be carry forwarded to the next recruitment year. It should be filled up by the available candidates of other feeder cadre in the same RY.

If the regular DPC of ry 2014-15 of ITO to ACIT occurred the consequential effect should be come to the ITO, ITI, OS,....in the same ry. Therefore review DPC may be held at the same time.
