ITO to ACIT promotion deferred

It is learnt that DPC for the promotion from ITO to ACIT, which was scheduled on 18th December 2012 has been postponed citing some legal issues. The details are still awaited. ITGOA has started a mass protest campaign like sending personal protest emails to CBDT.

Following are the details available from ITGOA website.
".....As you all will be aware that DPC for the grade of ACIT relating to RY 2012-13 (for 143 posts) was slated to be held on 18-12-2012.

There was objection from one ITO of Gujarat (Virendra Kumar) on holding of DPC for the grade of ACIT without revising the seniority of Inspectors and consequential seniority of ITOs, in the wake of Hon'ble SC's order in the case of UOI Vs. NR Parmar (CA 7514 & 7515 of 2005) wherein it is held that DR Inspectors will get the vacancy year for determining their relative seniority vis-a-vis PR Inspectors.

As the objection letter was written to UPSC, CBDT was advised to examine the objection in consultation with DOPT/Ministry of Law, if necessary, and offer comments specifically on the issue whether the ruling of Hon'ble SC has any cascading effect on the said DPC for ACIT.

DOPT stated that the said judgment is under examination and requires consultation with Dept. of Legal Affairs and UPSC. 
Accordingly, CBDT has sought opinion of Dept. of Legal Affairs and informed UPSC about the opinion of DOPT.

On the basis of above, a decision to defer the DPC for ACIT was taken on 18-12-2012. This decision of CBDT is clearly negative and smacks of utter indifference to the career aspirations of our members, because ITGOA (CHQ) had submitted in writing, as to how the said judgment of NR Parmar has no cascading effect on the DPC for 2012-13, as all the litigants were DR of 1995-96 and as per vacancy year will become DR of 1993-94 and the last ITO being considered for promotion were DR of 1990-91 (General) & 1991-92 (SC/ST). Hence, none of the litigants can ever be placed above the last ITO now being considered promotion as ACIT.

ITGOA (CHQ) strongly feels that this utter apathy shown by the Board calls for a strong protest. We will be seeking the support of ITEF (our partners in JCA) for the agitational program.

Meanwhile, all the Units of ITGOA are requested discuss this matter in their Executive/Managing Committee Meetings, which is essential for ensuring better participation with full commitment. A detailed circular in this regard, will be issued shortly.

Suggestions from all the Units of ITGOA is solicited within 3 days i.e. 24-12-2012, so that a proper notice can be issued to CBDT, which alone will bring back some semblence in to thinking of the these officials and force them to take judicious decision and do not play with career of our members."

  1. It is matter of great regret that DPC for ITO to ACIT is over delayed. The reason may be of any. Please try to sort out the obstacle.
