The website for electronic filing of I.T. returns is redisgned and and now available with a new smarter look. Apart from the existing services, it started a few mobile services. Instant mobile alert on different transactions are available if the service is activated. The log in feature in the original page is more secured now. Providing date of birth is essential in addition to the user id and password.

CBDT pursues FM for cadre review, promises additional 25K Crores revenue


Taxmen seek manpower, perks to mobilise Rs 25,000 cr extra revenue

Taxmen will mobilise an additional Rs 25,000 crore revenues each year in case government approves hiring 20,000 personnel afresh and recast existing pay and promotions structure for revenue officials to bring them on par with administrative, forest and foreign services.

The annual additional pay burden on the government due to this restructuring of income tax department would be Rs 400 crore that would be less than 2 percent of extra revenues to be mobilised.

Top taxation officials and chief commissioners of income tax will moot this proposal before finance minister Palaniappan Chidambaram when they meet him on Monday(03/09/2012).

View your arrear tax demand, if any

As a taxpayer friendly i nitiative, the Income Tax Dept. has enabled a service to allow the taxpayers to view there arrear tax demands, if any. This arrear demands have been posted by the jurisdictional Assessing Officers to the central database of Income Tax Dept.
Assessees can now view the arrear demand and pay accordingly or if it is a fictitious demand (already paid but not credited to their ledger by the A.O.), they can apply for removing the same against their account.

Taxmen withdraw agitation !!

As hinted yesterday the Joint Council of Action of the Income Tax employees exercised their "Exit Option" and withdrew the ongoing agitation. Practically, nothing has been achieved except mere formation of a committee to look into the just and reasonable demands of the taxmen. As many instances in the past, the leadership again succumbed in pressure of the administration. The rank and file may think whether to respond any such agitation call in future.

CBDT forms committee for redressal of demands of associations

CBDT has formed a two member committee to examine and redress the demands of JCA . The committee will submit it's recommendations within a fortnight for consideration of Chairman, CBDT.

According to sources, this is nothing but a facesaver to JCA, particularly the ITGOA fraction and to create a safe and smooth passage to withdraw the ongoing agitation  in the Income Tax Department without practically achieving anything out of the month long "non cooperation".

Central Board of Direct Taxes, in exercise of powers conferred under section 119 of the Income Tax Act, 1961, hereby extends the ‘due date’ of filing of returns of income for the Assessment Year 2012-13 to 31st August 2012 in respect of assesses who are liable to file such returns by 31st July 2012 as per provisions of section 139 of Income Tax Act, 1961.

Exemption of Salaried Employees from Requirement of Filing of Returns for Assessment Year 2012-13
Central Board of Direct Taxes (CBDT) vide its Notification No. 9/2012 dated 17th February, 2012 has exempted salaried employees from the requirement of filing the returns for assessment year 2012-13. The exemption is applicable only if all the following conditions are fulfilled:-

• Employee has earned only salary income and income from savings bank account and the annual interest earned from savings bank account is less than Rs. 10 thousand.

• The total Income of the employee does not exceed Rs. 5 Lakh (Total Income means Gross Total Income Less deductions under Chapter VIA).

• The Employee has reported his PAN to the employer.

• Employee has reported his income from interest on savings bank account to employer. 


• Employee has received Form 16 from his employer.

• Total Tax Liability of employee has been paid off by employer by way of TDS and employer has deposited TDS with central government.

• Employee has no refund claim.

• Employee has received salary only from one employer.

• Employee has not received any Notice from Income Tax Department for filing of Income Tax return.

e-filing made mandatory for certain Individuals and HUF


Central Board of Direct Taxes (CBDT) has issued a notification S.O. 626(E) dated 28th March 2012 vide which e-Filing has been made compulsory for Assessment Year 2012-13 onwards for
·         an individual or a Hindu undivided family, if his or its total income, or the total income in respect of which he is or it is assessable under the Act during the previous year, exceeds ten lakh rupees; and
  • an individual or a Hindu Undivided Family (HUF), being a resident, having assets (including financial interest in any entity) located outside India or signing authority in any account located outside India and required to furnish the return in Form ITR-2 or ITR-3 or ITR-4.

ITO to ACIT promotion for panel year 2012-13 - process initiated

Good news for the ITOs who are looking for promotion to the grade of ACIT. CBDT has started process of conduction DPC. For this purpose they asked for vigilance clearance and ACRs of ITOs from Sr No. 1203-1950 for General, 1455 to 2868 for SC and 1660-2868 for ST. as per all India seniority list of ITOs published on 14.01.2010.
The required documents to be furnished latest by 30th June.
The proposal for DPC is going to be submitted to UPSC shortly.

CCIT and DG conference in New Delhi on 11th and 12th June

Cadre Review likely to be announced
The top brass of the Income Tax department and CBDT will hold a brainstorming session on various issues related to black money, revenue collection and the proposed Direct Taxes Code (DTC) here next week.     The Directors General (DGs) and Chief Commissioners of Income Tax will get together on June 11 and 12 for their annual conference to deal with various challenges faced by the I-T department and the direct tax revenue collection set up, officials said today.     This will be the 28th edition of the conference. Finance Minister Pranab Mukherjee is expected to inaugurate the session on June 11 while senior officials of the Finance Ministry and those belonging to economic enforcement agencies under the Revenue department will participate in the event.     Some important policy decisions related to cadre restructuring of the I-T department and the Central Board of Direct Taxes (CBDT) are also expected to be announced during the conference, the officials said.     "Various issues and challenges being tackled by the department like the fight against black money, strategies for better tax collection and implementation of the proposed DTC are expected to be taken up during the two-day conference," a senior official said.     The conference will also deliberate on issues related to vigilance, technology upgradation and creation of infrastructure across the country. A similar conference of the top officials of the Central Board of Excise and Customs (CBEC) is at present underway here

Govt. bans post creation, cadre review likely to be delayed

In a move to cut down Govt. expenditure outflow, the finance ministry has launched an austerity drive. In a recently issued (31/05) Order, it has announced various cost cuttle exercises including a blanket ban on new post creation. As a result the possibility of early implementation of cadre review stands bleak. Until and unless Govt. loosens it's  farm stand on austerity measure and lift the ban on new post creation, it may be easily assumed that cadre review and restructure of the Income Tax Dept. like any other organization is delayed indefinitely.

Taxmen assaulted while on raid at Allahabad



Allahabad, May 30 (PTI) Three persons were arrested today in connection with the assault on Income Tax officials during a raid yesterday in a city-based hospital injuring 20 of the officials, police said. An FIR was registered at the Keedganj police station here late last night, hours after the raid and the subsequent assault on IT sleuths took place, police said. The FIR was following a direction from Uttar Pradesh Director General of Police A C Sharma whom senior officials of the Income Tax department met in Lucknow and complained about the behaviour of the staff of Jeevan Jyoti hospital here, they said. More than 30 people, including the hospital's owner A K Bansal, were named in the FIR following which three staff members of the hospital, including the security guard who was on duty when the assault took place, were arrested in the wee hours, police said. The FIR has been lodged under various sections of the IPC dealing with assault and causing grievous injury to deter a public servant from doing his duty. Raids were being carried out to arrest other people including Bansal, police said. Yesterday, Additional Director (Investigation) Income Tax Department Ajay Pratap Singh told reporters here that simultaneous raids were conducted at 15 places, 13 of them in Allahabad and one each in Gorakhpur and Delhi, following allegations of tax evasion by Bansal and his wife Vandana who run a number of hospitals, clinics and nursing schools in the city and elsewhere. Singh had claimed that computers and other important documents have been seized from the hospital for investigation purposes.

Ministry holding talk on cadre review of CBDT and CBEC : F.M.

"He said the ministry was in talks with the Central Board of Direct Taxes and the Central Board of Excise and Customs on cadre restructuring. “This will include the creation of a large number of posts and putting in place an in-built system for incentive and promotion. The fiscal situation of the country depends largely on the efficiency of the tax system in the country,” Mukherjee said.
To increase voluntary compliance by taxpayers, the I-T department is setting up Aaykar Seva Kendras to provide tax-related services, including filing of returns, through a single window system. At these kiosks, the taxpayer will be provided with a unique acknowledgement number against the service that can be used to keep track of the request or complaint."

I.T. cadre review : File back to CBDT

It is learnt from sources that cadre review proposal, which has been earlier cleared by DOPT with moderate reduction in ACIT posts, has been returned to CBDT asking for some clarification. It is expected to be sent soon for cabinet approval and subsequent implementation.
It may be remembered that CBDT is very much eager for early implementation and early promotions as they have asked all cadre controlling CCITs to get the APARs ready by 20th April 2012 for conducting early DPC in view of the cadre review proposal accepted by the Govt.

Extension of time for completion of assessments and reassessments


The existing provisions of section 153 and 153B, inter alia, provides the time limit for completion of  assessment and reassessment  of  income  by  the  Assessing  Officer.  Time  limits  have  been  provided  for  completion  of  assessment  or reassessment under section 143(3), 147, 153A, 153C, etc. Further, these time limits get extended if a reference is made under section 92CA to the Transfer Pricing Officer during the course of assessment/reassessment proceedings.  These time limits are either from the end of the financial year in which the notice for initiation of the proceedings was served or from the end of the assessment year to which the proceedings relate.

Tax rate for income above 10 lakh to be 30 per cent

Direct Tax Code for individual : Salient Features

The New Direct Tax Code (DTC) is said to replace the existing Income Tax Act of 1961 in India. DTC bill was tabled in parliament on 3oth August, 2010. There are big changes now in monsoon session and There are now much less benefits as compared to what were in the original proposal. I.T. returns may be accessed by mobile soon

Soon you will be able to access details about your income tax returns (ITR) and its processing on your cellphone. As the income tax (I-T) department is all set to enhance host of taxpayer-related services and shift to a new e-return filing platform in the coming months.
The new platform will come with various services, including one which will allow tax payers to check details such as refunds, deductions and tax demands on their cellphone.

Cadre Review : Note finalized, Cabinet nod soon.

It is learnt that CBDT has finalized the Cabinet Note for cadre review and restructure in Income Tax Dept. Within a week or two it will be presented to the PMO for including in the agenda for Cabinet meeting and the cabinet is expected to give it's consent in no time. Though ITGOA has objection in this proposal for reduction in entry level Group A posts with regard to the original proposal, ITEF has demanded early implementation. So the possibility of any unanimous move against the cadre review stands remote.

I-T department staff to go on daylong strike on February 28

Even as the officials continue to stay away from searches and surveys, a section of the staff in the income tax (I-T) department has decided to go on a daylong strike on February 28, to protest against outsourcing, contract policy, price rise and wage revision.



Under the banner of the Income Tax Gazetted Officers' Association (ITGOA), the ITOs, ACITs and DCITs are already protesting to demand promotions pending for the last two years from December 5. The protest was suspended on January 3 as the Central Board of Direct Taxes (CBDT) assured that they would resolve the issue by the third week of January. But since the issue was not resolved, they resumed the protest from January 31 and is still on.
Their protest has affected the search and survey works, thus slowing down the process of tax collection. "To add to it, the strike will affect the work badly. It would cause serious problems as the financial year is getting over in little over a month's time (March 31) and we are far behind the tax collection target," said a senior I-T official on condition of anonymity as he is not authorised to speak to the media.
While around 5000 inspectors and other staff in Mumbai alomgwith the rest of the country will stop work on the designated day, around 1,000 income tax officers (ITOs), assistant commissioners of income tax (ACIT)/deputy commissioners of income tax (DCIT) and promotee joint and additional commissioners would walk out of the offices after the lunch hour. On an all-India level, around 45,000 inspectors and staff would strike work while 8,500 other senior officials would support them.
Mumbai has a tax collection target of Rs2.04 lakh crore.
"We are also supporting the February 28 agitation.
The morale of officers and staff in the department is very low because of many issues including the delay in promotions," said Rajesh Menon, secretary general, ITGOA.
In Mumbai, 80 promotions of officers from the rank of ITO to ACIT or DCIT are pending for the last two years.
The number of pending promotions in the country is more than 400.

MPs want I T exemption limit to be hiked to 5 lacs



Ahead of the budget, some members of a Parliamentary panel scrutinising the Direct Taxes Code (DTC) Bill today pressed for raising the income taxexemption limit to Rs 5 lakh per annum.
The Standing Committee on Finance, which met under the chairmanship of senior BJP leader Yashwant Sinha, has decided to finalise its report by March 2, enabling Parliament to consider the ambitious reforms in direct tax regime.
“The Committee will meet again on February 24 and finalise the report on the DTC Bill by March 2,” sources said.
Some members, they said, “wanted the IT exemption limit to be increased to Rs 5 lakh per annum in view of inflation and erosion in purchasing power of rupee.”
The government is hoping for approval of the DTC Bill by Parliament in the next fiscal. Pending Parliamentary nod, the government may include some of its provisions of the Bill in the budget to be presented on March 16.
The Committee, in its draft report, has suggested that the income tax exemption threshold be enhanced to Rs 3 lakh per annum from Rs 1.8 lakh at present. The Bill proposes the limit of Rs 2 lakh and also provides for revising the tax slabs for all the three categories.
Currently, income of Rs 1.80-5 lakh attracts 10 per cent tax, Rs 5-8 lakh 20 per cent and above Rs 8 lakh, 30 per cent.
It had also proposed retaining the corporate tax rate at the existing 30 per cent.
The DTC, which will replace the Income Tax Act, 1961, was referred to the Standing Committee for scrutiny after introduction in Lok Sabha on August 2, 2010.

Cadre Review proposal of Income Tax Dept. as cleared by DOPT

The Department of Personnel & Training has at last cleared the Cadre Restructuring proposal Income Tax Department. There has been a reduction of 398 posts in the Group-A cadres up to the level of DCIT.
The proposal in   respect of Gr.B and Gr.C has been cleared by the Department of Personnel & Training without any changes.
Now the cadre restructuring proposal is expected to go to the Group of Secretaries and then to the Cabinet for clearance. Once it is passed by the Cabinet, the additional posts created will be allocated charge-wise and notification will be issued.
Promotions/recruitment will take place subsequently.
