Central JCA submitted 11 point charter of demand

"The Central JCA, in its meeting held on 02-06-2014 at New Delhi thread-barely discussed the issues/ problems remaining unresolved at the apex level for a long time and it appears that no sincere or discernible efforts have been taken by the Board to resolve these issues. The meeting further took stock of the situation in view of such long pending issues and rising resentment among the rank and file of its members. The meeting, therefore, chalked out an 11-point charter of demands concerning the welfare and career of its members for their immediate settlement by the Board to avoid any future industrial unrest in the Department. The said charter of demand is enclosed with this letter with the expectation that the Chairman, will sincerely address the issues on a priority basis within a reasonable period of time so as to avoid unpleasant situation in the department. "

  1. With the implementation proceedings of cadre
    restructuring in Income Tax Department, all the cadres
    i.e. Group A, B & C are being benefited. The government
    is expected to collect Rs. 25,000/- crore more revenue
    in stead of more expenses of Rs. 550/- crore after
    restructuring.
    It is well known that the stenographers are back bone
    of the department. The work of stenographers is
    important at all respects. This is pertinent to mention
    that the stenographers and ministrial staffs i.e. TA are
    promoted accordingly ratio of 1:3. The department
    knows the importance of promotion of stenographers
    indeed and that is why the above ratio was not changed
    in previous cadre restructuring.
    Only one stenographer is loaded with heavy typing and
    many miscellaneous work of the department. This heavy
    load of work is to such an extent that only one
    stenographer is assigned the total typing work of one
    range consisting 1 circle, 3 or 4 wards and 1 TRO office.
    How much contrary is this that only one stenographer is
    expected to do the whole work of a range which
    requires not less than 2 or three stenographer. At this
    stage it is said that who will perform the work of
    stenographer? A TA necessary not! And a work of TA
    which is presumed to be non-reflecting is also handed
    over to a stenographer.
    In previous restructuring, LDC (G.P. 1900) was
    promoted to TA (G.P. 2400). But, stenographer was not
    provided any benefits. The post of LDC was feeder cadre
    in the department and is filled through direct
    recruitment every year and the post of LDC/TA was
    continuously filled by the department. But, there was a
    long gap in recruitment of stenographers before 2008
    and after promotions the number of stenographers is
    few in the department.
    Now, this not only impertinent but also injustice to the
    stenographers to change the promotion guidelines and
    not following the ratio of 1:3. Because, the number of
    stenographers decreased in the department not due to
    promotion but due to non-recruitment against the
    vacencies of stenographers during 2000 to 2008. In the
    meanwhile the recruitment of ministrial staff i.e. LDC/TA
    was continuously on. Now, saying that the number of
    stenographers in the department is few and so the
    promotion ruls for stenographers requires changes is
    injustice to the stenographers and this is also not in the
    favour of department.
    This will be more effective in cadre restructuring if
    separate seneriority list of EA is created i.e. EA (TA)
    and EA (Steno) and during promotion to the post of ITI
    the same ratio of 1:3 is followed. Those EA who do not
    pass ITI exam will automatically be eligible for
    promotion to the post of OS/AO and PA/PS. This system
    of promotion will not only be beneficial for all staffs but
    also push them to work with more efficient manner.
    This will ultimately benefit the department.

    1. true lies..stenos should be barred from main channel as done in odr deptts..d promotions to d cadre of iti should be reviewd from 2001 onwards..n responsibility should be fixed on d officers who violated cabinet decision....

    2. D deptt. Not framed RR for ITI till date to oblige the stenos of d deptt n not implemented d decision of CAT Chd in d case of S K Bbardwaj Vs UOI till date.ITEF is also inveloved in d conspiracy.

  2. Frankly speaking' there is no need of stenos to the Income Tax department. The stenos are doing the works of Tax Assistant.
    They forgot the stenography and in some charges, they are being appointed as steno after being selected from staff selection commission even if after not qualyfing the minimum standard of stenography. So recently they are baring from appearing the ministerial staff exams. They should be merged with TAs by giving below in making inter se seniority so that there will be no litigations in promotions. And recruitment should be stopped onwards.

  4. Stenos in the Department get promotions very early i.e., ITI compared to Ministerial staff. No other department encourages such a fast promotions to the stenos. In fact, ITI is not their line of promotion. Their final promotions should be PA/Sr PS as is in other departments.

    1. Then ITI is also not the line of ministerial. They shld also b promoted only os/ao. ITI will be only thrugh direct recruitment. Pls see the past where steno will be prmted iti in atlst more thn 15 yrs. Now they will b prmtd soon due to not recuiting steno between 2002 to 2008. I dont know why ministrl staff have the prblm with steno in this deptt. A ta mostly bcom Sr. Ta in 2 or 3 yrs why steno will be in same post upto 5 yrs. Ye aapas ki ladai m dopt ke rules implmnt ho gye to bhul jana prmotion 5 saal tk phir lena baba ji ka thullu. So jo mil rha h wo le lo dusro se mt jalo.

  5. oooooooopppppppppssssss...... a very long comment from one of my brother but i couldn't understand what he want to explain. its simple to understand that there is no need of stenos in the dept. if an ITO dictate the paragraph to the steno he may also type the same thing within same time and the same is happening. When (at present) the strength of steno and OS/Sr.TA is not as earlier, there is no need for the similar promotion ratio (i.e. 3:1)and it is commendable to merge the post by creation of new post i.e. Executive Assistant.

  6. Why JCA charter is asking for Gr A and Gr B recruitment rules only ?
    How did ITEF SG Rajgopal sign that ? He forgot that he represents Gr.C ?

  8. What is the status of regular promotions for the RY 2014-15? Till last year, these promotions were happening in the First half of the year. But now there is no news regarding this. Even ITEF is not bothered about these whereas a larg number of vacancies are lying vacant in the cadre of Sr. TA inspite of eligible candidates for this year. TA/Sr. TA is the backone of the deptt ut still all focus is on ITIs.The upgradation to Sr.TA i.e. 2400 to 4200 makes a great impact in todays time and this is the major financial hike in the Group C or B.Therefore, my sincere request to My ITEF LEADERS to take this matter with board on a high priority basis to get instruction issued specifically for Sr.TA DPC for 2014-15 as most of the vacancies in other cadres have filled in 13-14 and also there is no timeline given for New RR for EA cadre.

    Please give your valuable comments in this regard.

    1. Hi Dear, I dont know from which region you are. In N.E. Region, DPC was not held even for R.Y. 2013-14 till date except for ITO. Those TA, STAs and OS who are eligible for promotion are denied even for more than 1 year...

  11. What is this charter of demand ? Surprisingly our union doesn't talk of grant of increment on promotion to the post of O.S. and Stenographer Gr.I. No wonder this demand has not been met even after DOPT issued a circular almost 2 years ago and on the basis of which lot of other departments have taken the benefit of fixation. When will the union take up this matter with right and earnest effort ? Surprisingly one of the bloggers has commented for the need of stenographers to be barred from promotion. My friend if the IRS officers uses this same yardstick and talks of barring group 'C' officials from entering to class-I service, then most of us would retire in the same post in which we joined. So don't talk of selfish motives which doesn't serve any purpose, but talk of growth which includes everyone.

  12. In the changed scenario stenos recruitment should be banned/must be excluded from the feeder grades to Inspectors urgently. The ITEF leadership vests in the hands of some stenos who cheated the mainstream cadres for the last 2 ,3 decades. Everybody knows that the ITEF managed to continue with 1986 RRs for STENOS benefits even in new restructuring, violating the cabinet approval, DoPT instructions, etec. etc.

Consequent to the recasting of seniority in the grade of Inspectors, what will be the fate of those who got fixation benefit as anomaly cited with DR Inspectors as minimum entry pay enjoyed by the prevailing seniority list at that time ? In almost all cases those DR Inspectors are now got higher position in the gradation list now. Can anybody clarify ?

  14. is new recruitment rule and restructuring sanctioning date is different. Why for vacancy year 2013-14 it was not applicable. Any one tell me. Why it is applicable for 2014-15. And why 2013-14 elgiblility criterea fixed from 01.01.2013 with old recruitment rule.

  15. As per 1986 OMs the inter se seniority will be fixed as pr,dr,pr,dr........ and so on not like pr,pr,pr.....dr,dr,dr...for any vacancies year or any carry forwarded vacancy. so there will not be any effect to the anamoly fixed at the time of promotion. is that clear dost.

  16. Dear sir if u want to banned the recruitment for stenos in this department u should write to DOP&T or SSC.......not in simpleincometax.... Stenos will take the benefit if they will selected in this department.... And for your kind attention the recruitment for the post of stenographer can't be banned in this department...so they are enjoying will enjoying......the future benefits.....

  18. direct entry in the income tax department should be only from MTS in the non gazetted posts. Because all the officials should know how the department functions from MTS to ITO. Hence, all the direct recruitment upto the cadre of ITI should be banned.

  19. Hyderabad CAT suspends promotion of 148 Income Tax Inspectors, this is what the headlines states in TOI, Hyderabad edition. The reason for this is as per Dr K Lakshmi Narasimha counsel for the petitioners had said to the press that 'as per the order of the centre all the posts of office superintendents, Sr. TAs and Stenographers were merged in a single cadre called Executive Assistants and promotions had to be effected by taking staff from this new category'This is even for the R.Y.13-14. Any comment on this.

    Every orders takes effect from the date of notification and not date of implementation - High Court of Kerala has unambiguously pronounced this in my WP(c) 9486/2009 considering the merger during 2001.

  21. Steno fights with TA and STA. TA and STA fight with OS and Inspector. Inspector fights with ITO. ITO fights with ACIT. ACIT fights with I don't know who. This is not a department. This is a fish market that stinks of hypocrisy and greed. There is no solution to all these problems. Everyone wants to be treated like Joint Secretary. Everyone needs his ego to be massaged. Where is the hierarchy? Where is discipline? It is all madness.

  22. Hon'ble Hyderabad CAT had done correct.CBDT should follow the Cabinet Approval order and also earlier order by CBDT Dated 31.05.2013. All orders should be revised on the direction of CBDT..
