One day strike paralyzed functioning of department, JCA threatens to stop Search/Survey

All the Income Tax offices throughout the country remained closed on Thursday, the 8th October, 2015 in response to a call for a one day strike, jointly issued by the Income Tax Employees Federation and the Income Tax Gazetted Officers’ Association.
Leaders will take stock of the situation on 11th October and decide further course of action.

  1. Need to intensify ongoing agitation immediately . Non participation in search/survey, stopage of recovery work , non disposal of scrutiny cases, etc should be considered for this purpose alongwith a call for indefinite strike.

  4. Who said that offices were closed.In delhi all offices were opened and running beautifully.Even CA's attended assessment proceedings. DR IRS officers know how to manage things.So movement has to be intensified.Need to stop survey and search action.We should say ki we will not do assessment. All cases should be transferred to Circle.

  5. If govt call for negotiations, one issue should be emphasised i.e.
    Why CBDT do not follow DOPT calendar for DPC? and fix responsibility individually on "Chairperson" or Pr.CCIT(CCA) if they do not conduct DPC as per DOPT calendar. As per DOPT calendar DPC for Vacancy Year 2014-15 should have been held in March 2014. Nobody can deny that CBDT is in default for not following DOPT calendar.

    CBDT may give excuse that reason for delay is implementation of NRP. It can be refuted saying that Supreme Court decision pronounced on Nov-2012 and how much time it needed to implement. 3 years are 10 times more than required to implement NRP.

    If JCA achieve in fixing responsibility individually for not conducting DPC as per DOPT Calendar, It will solve a big problem related to timely promotion.

    1. Direct IRS are Lords. They can even take their car drivers and conduct searches or surveys.

  7. Work to rule should also be included in the agitation. No work after office hours, Saturday, Sunday and holidays. Outsiders should be barred from doing office work.

  8. ITGOA should consider filing of Writ petition and contempt against CBDT for not following the DOPT calendar for DPC, which was prepared on the instance of the Supreme Court.

    O R D E R (ORAL)

    Mr. A.K. Bhardwaj:

    The only prayer made in the present Original Application filed under Section 19 of the Administrative Tribunals Act, 1985 is for issuance of direction to the respondents to consider the 18 posts of ITO in Delhi Region for the vacancy year 2014-15. The prayer reads thus:-
    (a) Call for the records of the case;

    (b) Declare that the 18 posts/vacancies of ITOs in Delhi Region which have arisen as a result of promotion order dated 10th September, 2014 are posts and vacancies of the year 2014-15 only.

    (c) Direct the respondents to fill up the said 18 posts/vacancies of ITOs as the vacancies of the year 2014-15 forthwith in Delhi Region.

    (d) Direct the respondents to consider and promote the applicant as ITOs against the said 18 posts/vacancies of ITOs in Delhi Region/ Charge.

    (e) Direct the respondents to give all consequential benefits to the applicants including arrears of pay and allowances;

    (f) Cost of the Original Application may be awarded in favour of the Applicant and justice may be done.


    2. Mr. Rajesh Katyal, learned counsel for respondents produced a copy of communication F.No.P-311/CAT/KK/2014-15/1076 dated 24.9.2015 addressed by the Office of Principal Chief Commissioner of Income Tax, New Delhi to him. In the communication, it has been amplified that the competent authority has taken a decision to consider 18 chain vacancies of ITO formed subject matter of controversy in the Original Application as the vacancies of the year 2014-15. Paragraph 2 of the communication reads thus:
    2. In this regard, I am directed to convey that the competent authority in this office has taken a decision to consider the 18 chain vacancies of ITOs under contention in the year 2014-15. I am further directed to take leave of the Court on holding DPC of ITOs for the year 2013-14 as the restriction imposed by the Hon ble CAT in this case also applies in another case in OA No.4334/2014 (Rajesh Kumar Gupta & Ors Vs UOOI & Ors.)

    3. In view of the stand taken by the respondents, the Original Application is disposed of as infructuous. In view of the final Order passed (ibid), the interim Order dated 26.11.2014 stands vacated. No costs.

  13. No use of strike. CBDT ko kuchh padi nahi hai regarding promotee ACIT. In Mumbai region search and surveys are in full swing. Inspectors(both promotee and direct) ko mal chahiye.
