As the DPC is over, everybody is waiting for the promotion order. As the F.M. will be in official visit to China from tomorrow, the promotion order is likely to be delayed for a few days. F.M. will return India on 28th June and then only the order may be issued.
So a little more wait.......

Perfect example for the Great Indian red tapism. R.S approved after long gap. Board took another 2 weeks to conduct DPC. Now FM out of country. When FM approves, Chairman will be either on tour or on leave. When board issues order, the PCCITs will raise objections by raising this or that clarification etc., For getting a promotion that too on adhoc basis this much frustration to members means how they can work enthusiastically in field?
ReplyDeletePromotion prospectus of lower grade employees may kindly be taken into consideration. There are many gròup C employees who are eligible for promotion and are going to retire shortly could have financially benefited. Now JCA should focus towards the welfare of lower staffs.

ReplyDeleteOh shit. Board people surely knows the FM's tour programme. Then why the hell they took so long time when it is a mere formality for adhoc promotions to get the approval of committee members, who all are in our board only. The IRS people deliberately dragging the acit promotion matter. Our association people are also incompetent to achieve positive results. We have to blame ourselves for this intolerably situation.

ITEF should pressurize mumbai admin to conduct regular dpc for ito for 2016-17 and there after adhoc promotion can be done.

मुंबई admin कभी नहीं सुधर सकता। आज v.y. 2016-17 के लिए ITI से ITO की DPC में कोई रोड़ा नहीं है लेकिन अक्षम admin regular प्रमोशन देने कीं जगह adhoc प्रमोशन का इंतज़ार कर रहा है। शर्म आनी चाहिए admin को जो regular प्रमोशन के हक़दार है उनको adhoc प्रमोशन देने का षड्यंत्र किया जा रहा है

ReplyDeleteRegularisation of adhoc promotion is the most URGENT matter before the ITGOA which should be taken up on war footing basis for promotions from ITO to ACIT(adhoc) in respect of filled in posts against the year 2014-15. This process should be an ongoing exercise until all the adhoc posts are regularised w.e.f. the date of reporting to as ACIT(adhoc) in the respective charges. If this matter is not taken seriously, it will again become another headache for the ITGOA. The adhoc promotions do not count for seniority and therefore this should not be an impediment in the process of further promotional avenue as DCIT, JCIT etc.The spirit of ITGOA should be in this direction 24X7.

Please refer to my earlier posts dated 02 March 15 and 10 Oct 14, on the subject.
As per the information received, yesterday i.e. on 30 June 2016, Hon'ble Supreme Court of India has, putting an end to all unnecessary litigation by Govt. of India, delivered its judgement clarifying loud and clear that Section 33 of the Persons with Disabilities (equal opportunities, protection of rights and full participation) Act 1995 entitles persons with disabilities the benefit of reservation in promotion in Group A and B posts as well and not just Group C and D. In a narrow interpretation, the babus of the DoPT have been restricting this benefit to only group C and D for a long time and despite court's rap at least on two earlier occasions, have continued to disregard the Hon'ble Supreme Court judgement.
The Hon'ble Court also struck down the DoPT Memorandum that denied the reservation in promotion for persons with disabilities in A and B categories. The judgement is historic and a major milestone in the fight for restoring the rights of persons with disabilities in India.
The argument in this case Writ Petition (Civil) No. 521/2008 titled Rajeev Kumar Gupta and Others Versus Union of India and Others, were concluded on 17.03.2016 and the bench of Hon'ble Mr. Justice J. Chelameshwar and Honble Mr. Justice Abhay Manohar Sapre had reserved the judgement.
Learned senior counsel Santosh Kumar Rungta, who was one of the leading counsels arguing the matter before the Hon'ble Bench has now urged the Union Govt. to incorporate this direction in the Rights of Persons with Disabilities Bill pending before the Parliament and specifically provide reservation to persons with disabilities in jobs irrespective of mode of recruitment.
Brief Background
It may be pertinent to mention that the Hon'ble Supreme Court had on 08 Oct 2013 in the case titled Union of India vs. National Federation of the Blind delivered a land mark judgment directing the Govt, of India and State Governments to compute 3% reservation for persons with disabilities in all groups of posts against the total number of vacancies in the cadre strength. The Hon'ble Court also laid down that the computation had to be done in an identical manner in respect of all groups of posts. Subsequently, the Hon'ble Supreme Court vide its judgement dated 10 Dec 2013 in a case titled as MCD Vs. Manoj Kumar Gupta upheld a judgment of Hon'ble Delhi High court which declared that Section 33 of the Disabilities Act, provided for reservation in promotion for persons with disabilities in Groups A and B also.
But instead of implementing the judgement, the Govt. of India had been contesting the issue through various frivolous litigation which were nipped in the bud each time by the Hon'ble Court.
