in the case Balwinder Singh Matharoo vs Union of India in OA no. 338/PB/2012 .
Letter has been issued by CBDT for calling suggestions for change/modification regarding ICT Policy. CBEC has given executive instructions for Implementation of CAT Order which is favourable for employees who avail ICT
DeleteCBDT should honor the apex court verdict. Association is not suppose to decide whether to implement or not the apex court verdict. Association should fight for common benefit and not for sectarian politics.

CBDT should consider the supreme court judgement regarding counting of past service of ICT employees for promotion. Considering the judgement of apex court and after consultation with DOPT, CBEC has already issued direction to all the cadre controlling authorities to count the past service of ICT employees in their department.Moreover, there have been four high court judgement and dozens of CAT judgement in our department in favour of counting the past service of ICT employees.How much money CBDT will waste in the form of litigation fees and how long it will harash the ICT employees. In this matters CBDT should not seek suggestions from the field offices, because it is the judgement of apex court which ultimately prevails over. Income Tax Association should not take the side of any particular group of employees in the court judgement, it should maintain neutrality in any type of court judgement and works for the common interests of our employees, so that all employees will heartly support and cooperate the Association.

ICT employee deserve to carry their past service at new charge as per Apex court and no one should be interfere in this regard. Thanks for co-operation.

ReplyDeleteAlso the same thing applies for Physically Handicapped Employees for reservation in promotion in group 'A' and 'B' . There are several Supreme Court's judgement in favour of PH employees including the latest one CIVIL APPEAL NO. 5389 OF 2016 dated 30 Jun 2016 in case of Rajiv Kumar Gupta and others Vs Union of India and others.
CBDT should consider the supreme court judgement regarding reservation in promotion of PH employees in group 'A' and 'B' also. How much money CBDT will waste in the form of litigation fees and how long it will harash the PH employees who are very less in number.
Supreme Court's remarks:
"It is disheartening to note that (admittedly) low numbers of
PWD (much below three per cent) are in government employment
long years after the 1995 Act."
Further Apex court has given decision as:
"we declare the impugned memorandum (No.36035/3/2004-Estt. (RES) dated 29.12.2005) as illegal and inconsistent with the 1995 PWD Act. We further direct the Government to extend three percent reservation to PWD in all IDENTIFIED POSTS in Group A and Group B, irrespective of the mode of filling up of such posts." (either by promotion or by promotion)
Still CBDT follows the above memorandum dated 29.12.2005 and denied the reservation in promotion in group "A" and "B" to PH candidates.
Very sorry to know the state of our department.

4. ICT will carry past experiences restricted to 3 years only.

ReplyDeleteमेने RTI में ITO पेपर 4 की कॉपी माँगी थी मग़र मुझे दिल्ली आकर देखने को कहा गया। मुझे 70 नम्बर मिलने चाहिए थे पर केवल 40 ही दिये गए ।
