As per the retiring Chairperson (Yes it is official, not from any so called "reliable source", though most of the news from sources proven correct) CBDT finalized the regionwise allocation of posts. She also informed that allocation for various functional units such as assessment, TDS, exemption, Investigation etc has been sent for FM's approval.

The dispute mainly relates to fixation of interse seniority in the Incometax Inspectors cadre among the promotes and the direct recruiters. The settled law as per the Supreme court order(2013) Meghalaya Public service commission case clearly stipulates that not only the advertisement but also the number of posts notified has direct bearing on the equality of opportunity in the matter of appointments. Originally, 5 vacancies were notified in the year 2005 notification for which the recruiting agency SSC has conducted examination (preliminary) . The recruitment process was inordinately delayed and finally completed in 2007. In the mean while additional posts 58 were identified by the department on 28th September 2006 and subsequently further additional posts numbering 759 were identified on 20th February 2007 by which time the recruitment process against the originally notified 5 vacancies was not complete. Therefore, filling up of the additional posts 58 + 759 which arose subsequent to the advertisement merely because, the process was not complete is a clear case of violation of fundamental rights relating to equality of opportunity in the matter of appointments.
If a fresh recruitment process is held for this 58 + 759 posts public in general who have acquired graduate qualification in 2006 and 2007 can also participate in the competition along with the serving employees in the Incometax who have prescribed qualification to contest. As against this appointing more number of people than the advertised number of posts in itself is illegal.
As per the Apex court’s order the additional number of people appointed have no right to continue in service , this being the case granting them seniority from the date of notification itself is a perverse decision and bad in law.
The plain meaning of the two expressions POSTS AND VACANCY make it clear that there must be a 'post' in existence to enable the 'vacancy' to occur. The cadre-strength is always measured by the number of posts comprising the cadre. Right to be considered for appointment can only be claimed in respect of a post in a cadre. CBDT has abolished the Incometax inspectors along with other cadres in the department available upto 2005 as a government policy decission and a fresh additional posts were created in December 2006 and the same was intimated to the SSC 59 posts in december 2006 and 759 posts were intimated on February 2007 and requested the SSC to advertise and recruit persons by comprising the schedule to one year that does not mean to say since the recruitment process already started in 2005 and not completed by that time and without giving subsequent notification is nothing but voilation of article 14 and 16 of constitution of India as the Graduates who have completed their degree in 2006 and 2007 have lost their chance to appear because on the lapse of SSC and CBDT. Thus when the recruitment is illegal and claiming seniority over the person who has long continuous length of service is totally perverse

new recruitment rule for ITI approved... no value for merit.one who tried hard to clear the ITI exam on the very first attempt knowing that there is a chance of earlier promotion has been fooled by the new rule with out giving any cut off date. It is regret and sad to say i am in the 4th place and is about to become promotion by virtue of earlier passing of exam will be down to 420 Nos below for ITI promotion thks to new recruitment rule. 4 se 420 bana diya....enjoy everybody........

Very good. Leaders are useless. They watch their own itererst. They have nothing to do with the welfare of the employee. Due to them there is a lot of gap between direct irs and promotee. Now they use this policy in inspector cadre also by way of n.r.parmar judgement. More than 10 months lapse announcing restructuring but no clear picture due to them. Unions are meant for strike only. We should get rid of baed chall and buycoot their strike call.
How much time it will take for promotion in the cadre of ITO and ITI? Is there anyone who can tell
ITEF will held responsible for any thing that will adversely affect the career of the inter chage tansferee TAs due to CR.
ITEF had never done any thing good for MTSs or TAs. No welfare at all. So it is useless for us. Contribution towards ITEF fund is simply wastage of your hard earned money. Keep away from this stupid organization.
If the new RR brings loss to one person, 400 + juniors are benefited, Everybody should welcome it in the interest of majority .
Pl update the details of recruitment rules if any whether passing criteria is abolished, if so please think about the procedure to file appeal in court for relief that it should be applicable to candidates passing from formation of rule not to old one who have already passed..do not afraid believe on law of our country justiice will be there.

ITEF has a long history of betrayal... but the mainstream cadres, who fell prey to their cunning and cheating activities, still clinging on to them is alarming...at least we must know what they have done all these years. They never can come out of their cheap cheating mentality.
Unlawful rules are being implemented by the unlawful ITEF leaders, with the Board which is totally indifferent towards the real problems of ministerial cadres.
I have been following the comments being posted in this blog for so many months. I is quite amazing to note that one Mr. K N Pusrushothoman is demonstrating antipathy over each and every policy of the Board as well as the approach of the Unions. I am incomprehensive of the verbiage used by him in every comment ‘main stream employees’. I am, being an employee of this Department feel that everyone from CCIT to MTS are ‘main stream employees. No one is expected to enter in the Department through backdoor. It is worth to mention here that there were incidents of employees leaving Department in search of better opportunities as they realized that the present one is not satisfactory to them. If one feels that his capacity and caliber surpass the present job there is no meaning in continuing; the world is so vide and the opportunities are enormous; sky is the limit. If someone utters that except me all others people are wrong, foolish and incapable of taking decisions, it nothing but out of megalomania. Authorities form rules and policies for the common good. Department cannot function only for the so called ‘main stream employees. Sitting on the gallery and criticizing about the match is very easy, but it is very difficult to play the game. It is my request to him that do not cut the branch where you sit. I wish to pos one question. What rights specially revered by some section of the employees to be considered for promotion, when all are equally qualified and competent? It is not a health practice to call some sect of the employees as ‘main stream’ and it will only help promote divisionism among employees when all employees are part of umbrella unions viz. What ITEF is going to do with "Breach of Trust" by CBDT ? What ever would be the outcome , good or bad, ITEF is wholly responsibile since it being the one and only one representing the whole lot of employees below officer cadre.

Mr. Anonymous – Yes, I am dead against the Board as well as the Union on certain points which are against the DoPT instructions.
1) The Recruitment Rules are to be amended every 5 years as and when the cadres and numbers of feeder grades changes and compulsorily on implementation of cadre reviews – What about the RR for ITI ? The department is following 1986 RR! Who is responsible for this ? and what for?
2) Do you know that a steno GP-2400 with 3 years service is being promoted as Inspectors with GP 4600/- leaving behind the direct UDC with 16 years service who have cleared the Exams some 10 years back ? Only fools can think that these are for common good.
3) Do you know that the DEOs of the Department? Now all of them are Inspectors – what was their mode of entry ? You may be in-comprehensive like so many – for the Department, Stenos and DEOs are technical cadres.
4) I am not to surrender or be submissive even if all of you ( being members of ITEF) UTTER that all humbugs done are true and legal. Nobody can say that ‘you can go out and seek your bread outside’, after promoting far juniors – never worked in the line of promotion- over 16 years senior who always worked in the core functions of a department.
5) My friend, with the help of your own hands and axe, the leaders were cutting the branch where you sit ! The leaders along with their counterparts are climbing on the main tree! This is the plain FACT.
6) Dear friend, for the last 23 years, with all my efforts and honesty I had worked- some time back for completing scrutiny, many of us sat till 10 pm for months together. As the steno was always on leave ( for lame excuses) , we had to do their work also. The same steno had been promoted soon after attaining 3 years as Inspector and we just, O.S (recently) an abolished post? Please don’t ponder over honesty and all. Here one who worked hard is left behind and the viewers snatched everything – happens only in this DEPTT. The idle members taken away everything, undue.
7) Let the viewers, snatch the promotions - but we should at least get the ACP, reviewed according to the hierarchy on restructuring – as TA is not promotion, it is just absorption – and advance increment for passing Inspector’s examination. The leaders and their counter parts will not support this as they have already got their undue promotion benefits.
