Member (P) informed ITGOA leadership that cadre review will be finalized by 26.02.2014. He also informed that proposal for DPC for ITO to ACIT promotion has been sent to UPSC. The date of DPC is to be informed by UPSC soon and promotion will take place in March 2014. The Member (P) informed this on 23.02.2014 in the BGM of ITGOA at Chennai. It is learnt from sources that 180 ITOs to be promoted as ACIT for R.Y. 2013-14. This is regular DPC for 2013-14 and NOT for additional posts due to cadre restructure.

From Reliable sources it has come to the notice that file of cadre restructuring has been referred to Narendra Modi ji for his advice being the future P.M. that if income tax is abolished, candidate appointed due to CR will be appointed in which department.

One request to all AAYAKAR family members. Don't indulge in any legal disputes relating to fixing of seniority. After allocation those who are getting promotion let them get. Seniority can be fixed at any point of time. The lawyers are pocketing our money by giving us false assurances.
For the next two years no promotions. All are requested to take rest.

Lot of DR ITI hoping to get the ITO promotion citing Parmaar case and accelerated seniority to get the ACIT promotion quickly by not opting to go to their home state despite opportunity came. Now recent Supreme Court judgement came as a blow as the 2008 batch is liable to be declared as illegal and void as required procedures not followed by the SSC. They are going to get the exit ticket soon.
Correct and work to remove them has already begun just wait for some time

The supreme court of India in civil appeal No. 979 OF 2014 held that the advertisement must specify the number of posts available for selection and recruitment. The qualifications and other eligibility criteria for such posts should be explicitly provided and the schedule of recruitment process should be published with certainty and clarity. The advertisement should also specify the rules under which the selection is to be made and in absence of the rules, the procedure under which the selection is likely to be undertaken. This is necessary to prevent arbitrariness and to avoid change of criteria of selection after the selection process is commenced, thereby unjustly benefiting someone at the cost of others. Further it held that Even under the Constitution, the power of appointment granted to the Chief Justice under Article 229 (1) is subject to Article 16 (1), which guarantees equality of opportunity for all citizens in matters relating to employment. ‘Opportunity’ as used in this Article means chance of employment and what it guaranteed is that this opportunity of employment would be equally available to all. This judgement is applicable to the Staff selection commision,the recruting agency is voilating the article14 and 16(1) since 2005 onwards. As SSC is advertising less number of posts and recruting in larger number of candidates. That means back door appointments.
So all the back door appointments should exit on back door at the earliest.

Why the board still delaying the allocation of posts when the ITEF has withdrawn their agitation 15 days back? Chairperson assured to implement C.R long back but she is on LTC. Its like when Rome is firing Nero played Biddle in his palace.

Letters drafting wont help. File PIL in Hon'ble Supreme Court or High courts and ensure that recruitment process of SSC for 2005 2006 and 2006-07 is declared null and void n quashed.

As a Government policy, the CBDT has abolished certain back log DR vacancy posts from 2001-02 to 2005-06 in different cadres and intimated to all states of their share of abolish DR posts , finally keeping 5 number of posts pertains to 2005. The same was intimated to SSC and SSC advertised prilims notification in June 2005 and prelims results and calling of application for main exam in July 2006 and cut off date of receipt of application from eligible candidates from prelimns was ended by August 2006. Hence, the opportunity to public was closed by August 2006.
Subsequently, the CBDT has created additional 59 posts in the cadre Inspectors in the month of December 2006 and intimated to the SSC on 28th December 2006. Further the CBDT has created additional 749 posts in 2007 and intimated to the SSC on 27th February 2007. whether SSC can appoint 808 candidates which were received subsequent to the closing of recruitment process ie August 2006 and more without giving further notification in 2006 and 2007 is clearly attracts the infringement of fundamental rights under article 14 and 16 of constitution of India and the appointment itself is illegal. How the NR permar case is applicable to the SSC notification 2005 batch.
The Honorable Supreme court in NR permar case has never ruled that for every DR will get seniority from the date of notification leaving the back drop of facts of applicability of DoPT OM 7.2.86 and 3.7.86 and 3.3.2008. that mean identification of vacancy,requisition sent to SSC and notification issued for the same posts/vacancy when the three should fall in the same year, the seniority recons from date of notification.
Every DR of 2005 batch are misleading the courts without bringing true facts of their case rather claiming that they are on par with NR Permar case. At the same time when they are involving the revenue as respondent, the department also not bringing the true facts through the standing councils before the courts. hence, the fault is with the administration and also with DRs for misleading the deptt and courts
