Dear friend, the issue of adhoc promotion/appointment has duly been discussed in 1986 OM issued by DoPT. However, ADRP was a considered decision of Govt. of India. DoPT OM is applicable in an ideal situation. As soon as Govt. took a decision to ban DR through ADRP, the decision of Govt. shall prevail over the provisions of said OM.

Now CCA, Gujarat is implementing it in all caders / applicable caders...we also support that.So the issue should be solved or should be dragged..???and in the process huge loss to all by retirement etc...!!!! what is the use with a rider that lower cadre seniority will be refixed? When? What about review DPCs from 1986? When unsettled seniority is there, how can DPC can be done knowingly fully well that the seniority is not correct? why to give advantage to 2005 exam batch candidates (who are appointed by back door entry and whole sale lid will be opened shortly ie., involvement of SSC/CBDT etc., in the scam) by giving them all the CR posts and not many of promotions were being given to rightful promotees(in whose cases the parmar judgment need to be implemented-when??)-- only ITEF/ITGOA can answer - no body to question this in GUJARAT which is a shining state.

to avoid litigation amongst employees and to demoralise the employees, at least now in the recent recruitment rules, why the CBDT is not making a rule that notional seniority could not be given till he/she joins the respective cadre service. This is not the new one. in en number of cases, the Supreme court has ruled that without born in the service granting notional seniority is bad in law.Hence, if this amendment is mentioned in the new recruitment rules, then at least from this recruitment rules, litigation could be avoided and could save the promotee employees from demoralization and they could improve the work.
Soon after issue of appointment letter to the selected candidate by the SSC, the limitation for joining time is only one month as per the DoPT OM 1995. If there was no request from the candidate within one month, the CCIT(CCA) has to refer this matter to CBDT and the appointment has to be cancelled. The Gujarat CCIT(CCA) has not observed this point and if any one has joined service after 3 months from the date of service of appointment letter, his seniority would counts from the date of joined the service in the respective cadre. Except south India, in all other states have no legal brain to view all points of corner when a review is taken up. My dear DRs do not think of Andhra, Tamilanadu, Kerala are not having brain. Mr.Chidambaram is from Tamilanadu. For best judgements in the service matters, the AP high court, Tamilanadu High Court and Kerala High court used to deliver. Remaining all depend upon the arguments put before them only.

TAs are 100% eligible to be promoted to the grade of IIT, provided that they have passed the departmental promotion examinations of IIT and if the vacancy still exists after giving promotions to all the eligible Sr.TAs / Stenos to the grade of IIT. No hindrance should be there on the way of promotion to the higher posts. Hope, Boad will show its green signal this time for the same. Please fight for your right and don't let any organization to play on your career.

Para 5.1 of Mumbai charge Circular regarding revised register of ITI says DR vacancies from 2001-02 to 2005-06 notified to SSC 2005 were 817. Then why did CBDT delare the selection of 24 candidates selected as inspectors trough SSC 2005 as surplus vide CBDT's F.No.A-12021/02/2008-Ad.VII dated 09.03.2009 and 29 out of 813 as surplus vide letter of even reference dt.20.08.2008. It is quite clear from the above that 5 posts got adjusted pertains to vacancies of post- 20.08.2008 and there were many candidates selected through SSC2005 are filled in the vacancies of post 2006-07. Now it seems some sort of cooking up is undertaken for giving seniority for all SSC2005 selected candidates from 2006-07.
In view of SC judgment it is not important what number of vacancies and when CCIT, Gujarat has reported to CBDT but what CBDT number of vacancies CBDT has reported to the SSC (Recruitment Agency) and the date of reporting thereof. In the present case the posts under the direct recruitment quota in the cadre of Income Tax Inspectors for the years 2002-03 to 2005-06 and 2006-07 were cleared by the Screening Committee in the Rectt. year 2006-07 as circulated by the CBDT, New Delhi vide its letters F. No. A.12021/17/2006-Ad.VII dated 14.11.2006. Thereafter, the vacancies were reported by the CBDT, New Delhi to the recruitment agency i.e. to the SSC vide letters F. No. A.12021/3/2006-Ad.VII dated 20th February, 2007. Thus, the initiation of recruitment process for the post of Income Tax Inspector began in the RY 2006-07. As such, the CCIT, Gujarat has rightly placed DRs of 2005 Exam in the Year 2006-07. Even then the Seniority List published by CCIT Gujarat suffers from the following serious defects:-
1. The SC judgment is land of law. Thus, the principle laid down in the case of NR Parmar is equally applicable in all cadres wherever direct recruitment exists. Nevertheless to say that the cadre of Inspector consists 2/3rd promotees. Hence, before drawing a revised seniority list in the cadre of Inspector, Seniority lists in the cadre of LDC, UDC and TA needs to be re-casted w.e.f. 1986. This may take some time but it would be better not only to draw a correct & true picture but to avoid a long ending litigation and mental agony.
2. The CCIT Gujarat has placed all the DRs of 2005 exam in the year 2006-07 without appreciating the actual vacancy position reported to the SSC in respect of Gujarat Charge. DRs only to the extent of vacancies reported are entitled to be adjusted with the promotee Inspectors of the Recruitment years 2006-07. Rest of the excess appointment are to be adjusted against the vacancies arising in future. Appointments in excess to the prescribed quota cannot plead for grant of any additional benefit of seniority flowing from wrong application of the roster. In other words, appointment in excess to the roster will not give such appointees seniority because necessary future adjustment are required to be made for aligning excess appointments wrongly given earlier. If it is examined with reference to the Sanctioned Strength of Inspectors cadre, it would be noticed that assigning of seniority in excess to actual vacancies reported would tantamount to excess appointment against the sanctioned strength, which cannot be said to be justified.
Is anyone is superior then S.C. ? When S.C. in the order of NR PARMAR saying about the advertised vacancy. Moreover, is anybody superior then, CONSTITUTE ? When in Constitute of India it is mentioned that if the person appointed without advertise vacancy the said person's entry is treated as the back door entry.
Mr.Jai Narayan Sharma, your comment that the 2005 batch DRs are rightly inter-spaced with the promotees of 2006-07 is not correct as per the Dopt guidelines. Dopt guidelines lays down that the date of initiation is date of reporting the vacancies to the SSC by the CBDT and the date of reporting in the case of 2005 batch was 20/02/2007. the promotees of the RY 2006-07 were promoted much before the date of reporting the vacancies to the SSC. The Pr.CCIT Gujrat has wrongly interpreted the dopt guidelines. of course the vacancies were created in nov. 2006 by virtue of mini cadre restructuring and the promotions in many states were made in the month of December06/January07. Creation of vacancies and Communicating of the newly created vacancies by the department are different things . The Dopt guidelines has clearly mentioned the date of initiation is the date of communication by the CBDT to the SSC So the concept of "Recruitment Year" does not arise, So the DRs of 2005 batch should interspaced with those promotees whose promotion took place after 20/02/2007.
The comments of Mr.Jai Narayan Sharma are appreciable, but the dopt guidelines lays down that the Date of Initiation is the date of reporting of the vacancy by the Board to the SSC. In the case of 2005 batch of Inspectors the date of communication was 20/02/2007 for the posts created by the virtue of mini cadre restructuring of 2006. Many states conducted DPC for the said posts in the month of December 06/January07. So placing or inter spacing them with the promotees of these months ie December/January or before that is incorrect. They should be interspaced with the promotees whose DPC took place after the date of communication i.e.20/02/2007. Pr.CCIT Gujrat should go through the Dopt guidelines once again and should revise the seniority. Secondly all those direct Recruits who existed in other department or who were in final year in some College or other should be placed as per their respective date of joining......!!!! As it is illegal to appear in seniroity list of two different departments at the same time !!!! Pr.CCIT ji (Gujrat Region) pl. look into the matter as just to save yourself from the contempt of the court you should not play with the career of the promotees .......
Yes. DRs ITIs of 2005 2006 and 2006-07 are illegally recruited. They are also fooling the judiciary and the administration. But finally truth will prevail.
what stopped itef from reaching courts/administration over so called illegal recruitment? This should have been done long back. In A.P charge, ITGOA publicly supporting these DRs pretending to be their future members. On the other hand ITEF even unable to question ITGOA leadership over this.

As far CCIT GUJARAT is concerned criminal charges agaunst ITEF circle officials r being pressed. Also CAT Ahmedabad n Gujarat H.C will quash the revised seniority list n DPCs if at all conducted subsequently. Please DR keep yrself updated how will u work as promottee AC or DC. If u see in Ministeries/CSS/AFHQ Services, Railway Board & more deptt... all employe's seniority counted from vacancy year... i.e. if a employee appointed by SSC batch 2006 & he joins the deptt.. on 2009.. his seniorty is counted from July 2007...for next promotion. But this deptt. does not follow the same. While NR parmar case is crystal clear.. & Dopt has given the direction for counting the seniorty from vacancy year.. then why all the deptt.. of cen gov are not following the same specially in IT deptt.. It will be follow & All DR posts take the promotional benefits in this deptt..
And it is the direct IIT who will retire as "PROMOTEE" ACIT OR DCIT.

As per connents of mr. Sanjeet, umit seems that Delhi CAT is going to deliver decision in favour of his cadre. Decision of any court is highly confidential.There is a question arise how he knows the decision of CAT delhi before it delivered.
Hon'ble supreme court deliver his decision in NRP case to decide inter seniority of promotee and direct recruitee, no date of implimentation was given. DOPT is nodal agency to decide the proceedure and date of impementation of any decision of courts and DOPT has issued guidelines after taking legal opinion of legal department and decide effective date 27.11 2012.Then why the question if giving seniority from 2005-06 or 2006-07 or any other date arise. It looks a section of person creating hurdle in development of deptt.

' i '. clearly indicate that.. the matter of seniority if already settled may not to be reopened the order of 1986.. it means if in Income Tax not settled the seniority from 1986 then they should revise the seniority from 1986 in all DR cadres i.e. Stenos, TAs, UDCs. and this order is not for only Income Tax Deptt.. it should be followed by all subordinate deptt.. of cen gov... ok.. dear ... iskaa mtlb h ki seniorty to revise hokar hi rahegi... dear or wo bhi vacancy year se hi... chahey tu c kuch b krlo.....

disgusting that admin is allowing such comments. Blogs should be for healthy discussion not for abusing a particular section of employees.
As of now it has been observed in this blog that ITEF is totally behind the IITs as if there are no other grades in this department, ITGOA is only interested about promotions of ITOs forgetting about the welfare of AOs and PSs. Similarly Board is fully interested about the commissioners only ignoring the rest. Kindly, look into the other grades such as MTS, Drivers, LDC, TA, etc. also, because they are the hands and legs of this department. Make your hands and legs stronger, so that they will work perfectly as per your direction.

Eighty percent DR ITI of so called 2005 batch were earlier in other departments such as Food corporation of India, C & AG, Railways etc.One cannot appear in the seniority list of two department simultaneously it is totally illegal can become further issue for litigation in Hon. High court or Apex court in future.Respected Principle CCIT's should keep this legal aspect in their mind while preparing seniority list of ITO's and should grant those DR ITI's seniority from the date of joining the department and not as per Apex

Due to essentiality of General Election Duty, preparation for departmental promotion examination has slightly been affected. Hence, through this blog, I may suggest that this year departmental promotion examination which is planned to conduct early may be postponed to the month of Nov 2014 . Hope Board/ITEF may consider this issue in favour of the staffs. Kindly comment in this matter please.
You had published that justice may be delayed but not denied. I am an ITI of 2007 Batch on promotion. I had not cleared the ITO Exam, because of that my juniors (around 10 nos.) got promoted. Now i cleared my department exam in 2013. When cadre review is going to be implemented only in May or June 2014 , why they are not considering the results of department exam 2013. Because of this more than 100 nos. of juniors in my region and more than 1000 nos. all over India will become my senior? Where is the justice now in my case and other similar cases of mine. Moreover the Board has denied date of passing to Sr. TAs, in that case also those who got their exams cleared in 2013 and are seniors are not being taken into account? what is the logic behind this? Where is the question of seniority and justice in the department? Please let me know! Rules are only for the benefit of a section of people and ITEF is also not doing proper justice. They try to protect their kith and kin only.

Sahab Log...With due respect to all of you once again...let me express my view that there is nothing Bad in being "Promotee"....Rather PRs(in all cader)are assets with their experience...one day I will be promotee IRS...and I am ready for that...I have highest regard for all my fellow staff members who are too much experienced to me....They are Promotee, that means they should be underestimated..I dont support...Fact is when something is decided..how can a group PR or DR can stop that legitimate due...??? Whether ITEF has properly handled the issue..??? Why this much hue & cry...We should respect the Law....Let us make ourself that much worthy that we will not be treated as PR or DR by our appointment..rather our ACT & Work will tell who is actually what..???
taking into DPC for promotion for the year of vacancies 2013-14, the examination results should be announced by 1st January of that vacancy year only. If not, his name will be overlooked to the 2014-15 year of vacancies. Even if by 1st January 2014 not clears the exam, his name will be shifted to 2015-16 vacancies and so on. For this doPT has issued instructions and there are court decissions about this which have ruled the principle narrated supra.
ALL ELIGIBLE TA'S SHOULD ALSO BE CONSIDERED FOR PROMOTION UPTO THE GRADE OF IIT AS PER VACANCY OF THE CHARGE. THE RECRUITMENT RULE SUPPORTS FOR SUCH PROMOTION, WHY NOT THE TA'S AVAIL THIS OPPORTUNITY.
