Scoop News : Region wise allocation of posts - "Nothing official

We could gather some information about region wise allocation of posts in some charges. The following figures suggested by sub committee No. 1 is not final , at least upto this point of time. No official confirmation, neither from association nor from local administration is available. Viewers at their full liberty whether to accept these figures as genuine or not. We can only tell about the figures that it may be close to actual allocation.

CIT to CCIT : Promotion order released

The long awaited promotion order from CIT to CCIT finally released today. A total of 32 CITs promoted to CCIT. The promotion of a few officers will be effective from 01.01.2014. With this order the deployment in new charge consequent upon the promotion has also been notified.

As many as 26 CCITs, upto 1978 batch are eagerly waiting to be promoted to the apex scale. It is matter of deep concern for many officers who are going to retire shortly, some of them in December itself. As per sources, UPSC to conduct DPC in end of December.

ITEF circular dated 13.12.13 reg cadre review, Parmar case and other matters

At last ITEF broke silence and issued circular regarding recent developments. As per the circular no breakthrough had been possible in the meeting with Chairperson on 09.12.13. The association is going to show demonstration on 18.12.2013 and further agitation programme will be chalked out.
Regarding allocation of posts, the formula suggested by ITEF has been totally ignored by the sub committee.
Regarding Parmar judgement implementation, it was decided to implement the judgement in all cadres.

Cadre restructure and "Parmar Judgement" implementation : Some inside news

Following information is gathered from different sources as no official inputs from either Administration of association is available till date. No claim is being made about the authenticity of these information and every viewer is requested not to take this absolutely genuine. Since this blog is being flooded with queries from viewers, we decided to share whatever we could gather as the genuineness can not be ensured at this point of time.
Core committee is dealing with all reports submitted by the sub committees and a meeting is scheduled with all stakeholders including associations on Monday, 16th Dec. The allocation of posts will be finalized anytime after 16th and before end of this month. All DPC and review DPCs for promotion to take place within 45 days of allocation. The merging of cadres for the feeder cadre of ITI will be done before effecting promotion. Revised recruitment rules will have to be approved by DOPT but for the interim period, an executive order effecting the same likely to be passed.
Regarding N.R. Parmar judgement, it is decided to follow the apex court judgement all over the country in all cadres. The date of requisition of vacancy to  SSC is to be taken as criteria for fixation of seniority for direct recruits.
Regarding regionwise allocation of posts, we could collect the percentage share like :
Mumbai 16%, Delhi (with directorates) 13%, Gujarat 7%, Chennai 7%, Pune 6.5%, Bangalore 8.5%, Chandigarh 8%, Lucknow 3.5%, Kolkata 4.5%, Kanpur 4%
It is once again reminded that the above information could not be verified from any authentic source and the factual position is not final (particularly the share of allocation) and may be changed.

Very crucial meeting with DGIT(HRD) reg Parmar case today

A very important and crucial meeting of associations with DGIT(HRD) is scheduled today regarding implementation of Parmar judgement. It is learnt that representatives of different CCIT(CCA) are also going to attend the said meeting. The matter is likely to be decided today and it is expected that a uniform policy about fixing of seniority issue between Direct and Promotee employees to be chalked out. Regarding allocation of posts, everybody is tight lipped and it may be assumed that last minute negotiation is going on as the rumor is already in the air about the difference of opinion in the leadership of service association in this regard.  
Everybody is waiting keeping his finger crossed. Updates will be provided as and when available.

Some inside news of 9th Dec meeting - Not authenticated

Any service association has not shared anything about yesterday's meeting with chairperson. Even, they did not say whether the meeting actually took place or not. Still, some inside news is coming out. It is told that the notification will be published within 15 days. Regarding chargewise allocation of additional posts, it is yet to take final shape as the members of ITEF are divided in opinion. The Mumbai lobby of ITEF stressed that the allocation should be based on collection of revenue only. The Kolkata counterpart denied this model and they opined about both collection and workload to be considered. 
The above information is not from any authentic source. This should not be relied upon without verification. Still the information as could be gathered is published here to satisfy the queries of our visitors at least upto a certain extent.

Quarterly meeting with Chairperson today

Quarterly Review Meeting of ITEF and ITGOA with Chairperson, CBDT is scheduled today. Implementation of cadre review is likely to be discussed in the meeting. It is informed that all sub committees have submitted their report. Another crucial meeting of ITEF & ITGOA with DGIT (HRD) is scheduled on 11.12.2013 to discuss about the implementation of cadre review in the light of Supreme Court judgement in the case of N.R. Parmar. A clear instruction, uniform across  the country, is expected as the outcome of the said meeting.

Promotion to CCIT soon

Update on 12.12.13 : Promotion order is likely to be issued at any time. The file went for FM's approval on Dec 6 and most probably, the process is complete by now.
It is learnt from sources that promotion order for the post of CCITs is going to be issued within a couple of days. It may be today or tomorrow. The list of 37 CITs eligible for promotion has already been published on 27th of last month.

Implementation of Supreme Court order on Inter-se Seniority: Likely to be finalized on 11th Dec

ITEF and ITGOA participated in a meeting with DGIT(HRD) yesterday regarding implementation of Parmar judgement. Some more inputs in this regard are to be obtained and it was decided to finalize the issue on the next meeting on 11th December 2013.

"On our persistent demand and discussions with the Chairperson and Member (P&V), for withdrawal of the Instructions issued by the CBDT on 15th October, 2013 and issuance of clear instructions to CCAs regarding the manner of implementation to bring about uniformity in the matter in all Charges, a meeting of ITEF and ITGOA representatives were convened by the DGIT (HRD) and other Officials on 3rdDecember, 2013.

 In the meeting broad consensus were reached on many of the points to implement the Judgement.  In order to convey a clear cut and uniform instructions to the CCAs, the meeting felt that some more details are to be obtained from various agencies of the Government/sections of CBDT etc. and decided to meet again on 11th December, 2013 to finalaise the issue.  We are hopeful that the matter will be resolved in the said meeting and proper instructions issued thereafter to CCAs to implement the judgement in a uniform manner in all Charges and in all Cadres."

Gist of discussion in Video Conference on 28.11.2013

Today Video Conference of CBDT with CCsIT and DGsIT has been held on scheduled time. All the predetermined issues including issue of Cadre Restructuring were discussed. CBDT informed that reports of all subcommittees except Subcommittee for allocation of posts and jurisdiction have been received. It is also informed that this subcommittee will submit the report tomorrow i.e. 29.11.2013.

Agitated with ITEF, direct inspectors of 2005 batch resigning from association

Yesterday on 27.11.2013 on the anniversary of Hon'ble Supreme court decision in the case of N.R.Parmar & Others, Direct Recruit Income Tax Inspectors of 2005 batch resigned from the membership of ITEF as the Group C employees union is showing step motherly treatment towards DRs. They also  requested their respective DDOs to not to deduct ITEF subscription from the next month.
One of such resignation letter is with us and it is being reproduced here. For the sake of privacy the name and charge has intentionally been masked.

CCIT promotion : Order re-issued

A list of 37 number of officers published by CBDT in F.No. A-32011/02/2012-AD.VI Dtd. 27.11.2013. The officers are requested to exercise online option for posting within 29.11.2013. The vacancy position is also enclosed.
The list was first published yesterday but due to some unknown reason, the order had been removed very quickly from the official website.

It is learnt that the reason behind withdrawal of promotion list from the official website is that it contained name of two such officers who had already retired.
The retired officers whose name were inadvertently mentioned in the list were Mr Srinivasulu and Mr Kuldeep Singh.

Video conference on Cadre Restructuring

CBDT convened a video conference with CCITs and DGITs on 28th November at 4 P.M to discuss various issues. One of the agenda item is the implementation of cadre restructuring.
Besides CCsIT & DGsIT, all administrative Commissioners of Income Tax, CsIT (TDS), CsIT (Central) and DsIT (International Tax) would also attend the Video Conference.

Surprisingly the orders linked below are removed from irsofficersonline.gov.in . May be for some technical reason, let's wait and see....we will inform you when it will be available again.....the second in the list is Mr Negi, while the last name is Mr B.D. Sharma.....three panel years of 1, 34 and 5 no. of officers included.
CBDT published the list of Commissioners who are going to be promoted to the post of Chief Commissioners of Income Tax. A total number of 40 officers are going to be promoted. The DPC was held way back in the month of September and the ACC approval was being awaited for.

Meeting with Chairperson postponed to 9th Dec. Promotions to be effected within December.

The quarterly review meeting with Chairperson CBDT has been postponed to 9th of December. Member(P) informed that the sub committee for allocation of posts has been asked to submit it's report by 29th November so that promotions may be effected within December.

"The meeting was scheduled to be held on 22.11.2013 at 3PM.  The meeting was convened after a gap of nine months on our persistent demand.  To our utter disappointment, we were informed at the last moment that the Chairperson is engaged in some urgent meeting and the QRM has to be rescheduled.  We were then invited by the Member (P) and the meeting took place in her office in the presence of JS (Admn) and US (Ad-IX) from the Official side. From the ITEF side Coms. Ashok B Salunkhe (President), KP Rajagopal (SG), Ravi B Nair, Yeshwant Purohit ( Joint Secretaries) and Rupak Sarkar (Finance Secretary) were present in the meeting.  ITGOA was represented by Coms. Sita Rama Rao (President), Rajesh Menon (Secretary General), R.S. Meel and Divakar Singh.    In the meeting the following issues only could be discussed.
  1. Implementation of Supreme Court Order in Union of India & ors vs. N.R. Parmar & ors. We demanded, as decided in the CWC meeting held at Jaipur on 19 & 20th Oct. 2013 the withdrawal of the instructions issued by the CBDT in F No. C-18012/26/2003-V&L dated 15th October 2013 and issuance of clear and unambiguous instructions to CCAs for implementation or otherwise in a uniform manner in all Charges and all cadres.  The Member (P) assured us that the said instruction will immediately be withdrawn.  We were also requested to provide inputs with regard to its implementation.

  3. 2.      Allocation of Cadre Restructuring Posts for effecting promotions in the month of December, 2013.  It was informed that the Sub-committee for Allocation of Posts and Jurisdiction has been asked to submit its report by 29th Nov. 2013 and the manner of its implementation can be discussed and worked out in the rescheduled QRM on 9th December, 2013 after discussion with the staff side.
  4. 3.      Stoppage of payment to Daily Paid/casual labours who are engaged and working in the Department continuously for years and withdrawal of the same. We have requested to withdraw the above instructions issued by the Board in this regard taking into account their long service in the Department; the assurances given by the Finance Minister to these workers to regularise the eligible candidates in the newly created posts of MTS and in the light of the stay granted by the Principal Bench of the CA Tribunal.  We were informed that all efforts were being made by the Board to help the casual labours but for the instructions of the DOPT.  We were also assured that if the Principal Bench of the CA Tribunal has stayed the operation, efforts will be made to implement the same in all cases.
Anomaly in pay fixation for Promotees and Direct Recruitees at entry stage.  As you are aware that this point, taken up  in the National Anomaly Committee was not accepted by the Government other than allowing stepping up of pay wherever possible.  Further the ITEF had separately taken up the issue of fixation of pay of Inspectors/AOs/PS, on the lines of clarification issued in the case of personnel in the CSS/CSSS (Central Secretariat Staff).  The same was turned down by the Department of Expenditure.  Upon the objections of the Accounting Department and directions to recover the alleged excess payments, we again persuaded  the CBDT to take up the matter with the DOE. The Board, with the approval of the Revenue Secretary resubmitted the proposal with additional inputs, sought the approval of the Department of Expenditure. Now the Department of Expenditure have conveyed their disagreement and turned down the claim for the second time.  On this issue, in similar circumstances, some other major organisations affiliated to the Confederation of CG Employees and Workers, are contemplating legal recourse.  Some organisations have already filed Petitions in the Principal Bench of CA Tribunal.  ITEF CHQ feels that we may also join or separately file similar Petitions in the Principal Bench of CA Tribunal.  Since the matter requires immediate steps, in order to take a formal decision, all the Secretariat Members and Circle General Secretaries are requested to convey their opinion in this matter by 30th November, 2013.  The opinion may be conveyed through SMS or Email in the following format to the CHQ to contemplate further necessary action in this matter.
“Legal Approach for Pay Fixation Benefit- “ YES” or “NO”.
Increase of Local Travel Expenses to Inspectors and Notice Servers. Our demand for increase in the quantum of reimbursement equivalent to the cost of 50 Ltr and 30 Ltrs of petrol to Inspectors and Notice Servers was accepted by the CBDT.  Additional inputs with regard to justification of our demand was provided to the authorities vide our letter No. N-1/O-2/12-15 Dated: 30th Sept.2013.  It is learnt that a reference has been made by the Board to all the cadre controlling authorities as to what should be the quantum of increase.  Copy of the above letter of ITEF is enclosed herewith.  The Circle General Secretaries are requested to air opinion in similar line, with the cadre controlling authorities and pursue the CCAs to send their views at the earliest."

The President is pleased to promote the following officers of Indian Revenue Service from the grade of Deputy Commissioner of Income Tax to officiate on regular basis in the grade of Joint Commissioner of Income Tax in the Pay Band 3 — Rs. 15,600 — 39,100 + 7,600 (Grade Pay) with immediate effect.

Some details about progress of cadre review sub committees

Some details about the progress of cadre review sub committees have been made available from a source of ITEF Andhra Pradesh circle. Following developments regarding cadre review took place and we reproduce the summary here.
1. Staff car drivers to be converted into NS/TA. Proposal for necessary changes in the recruitment rule to be followed by the committee.
2. Daily Paid Workers are being actively considered to be absorbed as MTS.
3. Compassionate appointment posts will be filled up in one go, arising out of fresh vacancies.
4. Efforts are being made to publish new recruitment rules before promotion. If it is not completed, the vacancies will be filled in by Executive Orders for quick implementation.
5. After merger of SR TA/OS/Stg Gr I into Executive Assistant, there will be three options for promotion :
a) Inspector : After passing ITI Exam
b) A.O. : After passing an exam in Office Procedure/Admn.
c) P.S. - after obtaining training in Indian Secretarial Institute.
6. The earlier residency period for promotion from 2400 Grade Pay to 4200 was 3yrs for TAs and 5Yr for stenos. The sub committee proposed to make it 3 yrs for all cadres.

It is also learnt that chargewise allocation has almost finalized and indication towards statewise allocation may be known very soon.

Regionwise allocation of posts still awaited

CBDT yet to issue order of region wise distribution of additional posts consequent to cadre review of Income Tax Department. Rumour in the air is that seniority list of Inspectors to be re fixed as per the Supreme Court directive in the "Parmar" case. After obtaining compliance report from each of the cadre controlling CCITs, they will issue the distribution of the posts. Though it could not be confirmed from any authenticated source till date.
Latest allocation of region wise posts as on 31.03.2009 is provided for the viewers to enable them to calculate the possible break up of additional posts.

It is learnt from sources that CBDT has finalized the region-wise allocation of additional posts created due to cadre restructuring. Detailed order in this effect is likely to be issued within very short time, most probably in the next week itself. No authentic news about distribution of posts is available with us. It will be published in the blog as soon as any definite information is received.

CBDT's letter dated 15.10.2013 regarding re-fixing of seniority as per N.R. Parmar case

CBDT sent a letter to all CCIT(CCA)s regarding refixing of seniority of all category of officers. Surprisingly, the letter, without any specific direction in any time bound exercise, merely communicated the observation of DGIT(HRD) about the Supreme Court judgement. According to the comment mentioned in the letter, CCIT(CCA)s to follow the seniority as per 2008 guideline till upto 03.03.2008 and if it is not followed in any region, it needs to be reversed.

CAT Kolkata judgement reg. seniority issue of direct Inspectors

CAT Kolkata Bench delivered judgement regarding seniority issue of direct recruited Inspectors. As expected, the bench directed in favour of direct Inspectors in the light of verdict pronounced by Supreme Court in the landmark "Parmar Case". Significantly the bench did not say anything regarding any stay on promotion for the interim period. Does it mean that CCIT(CCA) Kolkata can go ahead with normal promotion process subject to future recasting of seniority ?

Process for ad hoc promotion to the post of JCIT is found to be stalled due to deficient APARs of 15 officers. CBDT asked the respective CCIT(CCA)s to get the deficiencies removed at the earliest. The concerned officers are also advised to take initiative in this regard.

According to information available with us, DPC for the promotion to the post of Chief Commissioner of Income Tax has taken place. As per sources, the last name in the list is Mr B.D. Gupta. Promotion order is awaited.

Addl CIT to CIT : DPC next week

As per sources, DPC for the promotion of 1991 and 1992 batch IRS officers (Addl. CIT to CIT) is likely to be held in the last week of September, though UPSC is yet to finalize the exact date. As many as 53 Addl CITs are going to be promoted to the post of CIT.

Cadre Review : APAR/ACR of ITOs to be sent at the earliest

In a communication to all cadre controlling CCIT, CBDT has asked for ACR/APAR of ITOs upto F.Y. 2011-12 urgently to finalize the DPC process for promotion to the post of ACIT. It is once again reminded to get ACR/APARs of all staff updated so that the process of promotion can be exercised at the earliest, soon after deployment order is issued.
The list of ITOs with deficient APAR is also communicated to the CCAs for urgent necessary action at their end.

As per information available from unofficial source, DPC for promotion to the post of CCITs has taken place today (17/09/13). Promotion order is likely to be issued within 10 days.
DPC for the promotion to the post of JCIT is likely to be done within a few days. As per information available with us, 191 DCITs are going to be promoted.

Cadre Review Update : 13.09.2013

CBDT has asked for information regarding vacancy position and No. of year taken for promotion in the case of last person  promoted in each cadre of Group B and C employees. This information is urgently sought and to be made available within 20th of this month.

In another communication, list of deficient ACR/APARs of IRS officers from 1992 to 1996 batches has been sent to concerned CCIT(CCA) to get it completed by 30th September to enable CBDT to hold the DPC meeting for promotion.

DPC for the post of JCIT soon

CBDT asked all ACR/APARs of 2004 batch and earlier left over IRS officers to be completed within 13th of this month. DPC for the promotion to the post of JCIT is going to be conducted soon (as per source, within September). In a communication to all CCIT(CCA), the list of officers with deficient ACR as on 6.9.2013 is sent.  The officers concerned are also advised to take initiative to get their ACR/APARs updated.
