Break up of additional posts as per cadre review as cleared by cabinet

After the cabinet approval of Income Tax cadre review, everybody is eager to know about the additional posts to be created, cadrewise. Though there is no official document is available in this regard, different sources have confirmed the cadre wise posts to be created. It is reproduced below for the viewers. Cabinet approved I.T. cadre review and restructure

Restructuring of the Income Tax Department
The Union Cabinet today approved the proposal for creation of 20,751 additional posts in the Income Tax Department in various cadres that is 1349 additional posts in the IRS cadre and 19,402 additional posts in the non-IRS cadres. This will help the Income Tax Department collect increased revenue and provide better tax payers services. An additional expenditure of Rs. 449.71 crore per annum is likely to be incurred on creation of additional posts and upgradation of some existing posts. This additional expenditure would be more than compensated by the increased revenue of more than Rs. 25,000 crore per annum proposed to be generated as a result of this exercise.

Cabinet likely to approve Income Tax cadre review today, 23rd May'13

As per sources, the much awaited Income Tax cadre review is likely to get cabinet approval today. This cadre restructure exercise will create additional 19000 posts in the coming two years. Out of which about 800 will be IRS officers.

Deductors to download Form 16/16A from website

ATTENTION : TAX DEDUCTORS
All deductors including Govt. deductors should download Form 16 and Form 16A from TRACES website and issue them under proper authentication. Form 16 to be issued annually while Form 16A to be issued quarterly. It is mandatory for all deductors to prepare from 16A for all deduction after 01.04.2011 and Form 16 for all deduction made after 01.04.2012 online.

Cadre review cleared by group of ministers

Paving the way for launching a massive recruitment drive to hire around 19,000 tax officials across the country in the next couple of years, the group of ministers on cadre restructuring of income tax department on Monday gave its nod to the proposal of substantially increasing the strength of revenue officials. 

These recruitments will take place in a phased manner. While 800 of them will be recruited as Indian Revenue Service (IRS) officers in Group A, remaining over 18,000 will be employed as Group B and Group C officials. 

"The proposal will now go to the Cabinet. The recruitment drive will be launched after getting Cabinet approval," an official said. 

Sources said the GoM -- comprising finance minister P Chidambaram, home minister Sushilkumar Shinde, environment and forests minister Jayanthi Natarajan and minister of personnel V Narayanasamy - also decided to extend the rank and pay of special secretaries to chief commissioners of large income tax zones and to chiefs of various directorates under the Central Board of Direct Taxes (CBDT). 

It is learnt that the group of ministers gave its nod to increase the strength of IRS and other income tax officials despite opposition to it from Narayanasamy who argued that other departments may ask for increasing the strength of their respective cadres once the government allows it for income tax department. 

The proposal was, however, cleared when the finance minister convincingly spoke on the merit of the decision. Ministers, during a brief meeting, agreed that the move will significantly increase the efficiency of tax administration at the time when the government is committed to increase its tax collection besides providing better and faster delivery of services. 

The finance minister is learnt to have dismissed the argument that creating a higher number of senior positions would lead to problems pointing out that even states such as Andhra Pradesh had several chief secretary rank officials and there were more director general of police in place than the number of states. He noted that his ministry was going to undertake a restructuring of roles of the officials in order to ensure a greater mopping up of taxes. 

It was pointed out in the meeting that the move would not only help tax payers in getting quicker refunds, but would also detect the high net worth individuals who, at times, either escape the tax net or just end up under-paying taxes.

ITO to ACIT : Promotion order released

The much awaited promotion order from ITO to ACIT for the panel year 2012-13 finally released. A total number of 141 ITOs have been promoted to ACIT. The newly promoted officers have been asked to exercise their option for posting.
The order is available in irsofficersonline.org but as it it available only for IRS officers to view the contents, the order copy is being provided for everyone.

Cadre Review : Group of Ministers to meet on 29.04.2013

Let's visit the current status of the case. TIOL has come to learn that the CBDT case, which has been running months ahead of the CBEC, was finally referred to the Committee of Secretaries after the DoP&T came up with their partisan prescription to make amendments in their proposal. The issue has presently been escalated to the level of a Group of Ministers (GoM), headed by the Defence Minister. There are about half a dozen other key Ministers in this GoM, which is slated to meet coming Monday (April 29). The only item on its agenda is to look into the fairness of the demand made by the CBDT and how justified is the rejection by the DoP&T. If the GoM approves the proposal with a few alterations, it would pave the way for the CBEC proposal, which has been approved by the Finance Minister recently, and it has to now snake through the Department of Expenditure and then to the DoP&T before it gets the 'bureaucratic nod' to get escalated to the Cabinet-level. The only hope for its speedy clearance is the decision of the GoM on the CBDT proposal. Whatever formula is accepted for the CBDT, the same would apply to the CBEC, which is gearing up for the proposed GST but has not taken any new posts for now matured Service Tax.

I.T. employees to get mobile,Inspectors Laptop, petrol allowance for outdoor staff to be increased

It is learnt that all Income Tax employees are going to get mobile handset as an incentive. The petrol allowance of Inspectors and Notice Servers is also going to be hiked. Inspectors will get reimbursement of 50 litres of petrol (currently 30 litres) and Notice Servers to get 30 litres(currently 15 litres).Inspectors will get laptops instead of motor cycles as demanded earlier. Both the demands have been accepted by CBDT and awaiting Dept. of Expenditure approval.

As per the latest news available with us that the cadre review file is being examined by Group of Ministers led by Sri. A.K. Antony and likely to be submitted to the cabinet by second week of April 2013 for final approval.

As per a proposal before a group of ministers (GoM) led by defence minister AK Antony on cadre restructuring of the income tax department, about 800 senior level officers in Group A and more than 18,000 Group B and Group C employees will be hired once the ministerial panel and the Cabinet clears the proposal.

New 15G and 15H forms introduced for F.Y. 2013-14

Income Tax Dept. has changed 15G and 15H forms for non deduction of TDS from Bank Deposits and certain other deposits. From the F.Y 2013-14, new forms to be submitted to the deductor for non deduction of TDS. As earlier, these forms , 15G (for non senior citizens) and 15H (for senior citizens) to be submitted in duplicate alongwith copy of PAN Card.

INcome Tax Cadre Review and Restructure : Cabinet nod likely on 21st March 2013

Update : No cabinet meeting took place on 21.03.2013
It is learnt from ITEF sources that much awaited cadre review proposal, after clearance of Committee of Secretaries, now endorsed by Finance Minister on 12th March and submitted for cabinet approval. Next cabinet meeting is scheduled on 21st March and possibly it may be cleared on that very day.

On account of holiday on 27th and 29th March 2013 and the current financial year is going to end on March, CBDT decided to keep offices open on saturday and sunday, the 30th and 31st March 2013 throughout the country to receive returns.

Cadre restructuring underway in CBDT, CBEC : Revenue Secy


Cadre restructuring of CBDT and CBEC is underway, Revenue Secretary Sumit Bose has said.
This would lead to more commissioners to be deputed at appellate levels to deal with backlog of cases, Bose said at a post-budget meeting with FICCI members here today.

Taxpayers with annual incomes exceeding Rs 5 lakh will be required to file their returns in the electronic form, a senior finance ministry official said today.

The finance ministry is also making provisions for the e-filing of wealth tax returns.
“Income tax returns for the group above Rs 5 lakh will be e-filed. This is a move towards using technology so that the interface between the assessing officer and assessee is minimised,” revenue secretary Sumit Bose said at an industry event.
The government had last year introduced the system of e-filing of returns for assessees with an annual income of Rs 10 lakh and above.

ITEF to observe two days' strike, ITGOA keep safe distance

ITEF, the Group C organization of taxmen are going to observe two days' strike on 20 and 21st February 2013 in the line of Central Trade Unions but surprisingly the promotee officers' association (ITGOA) is not doing so. They are only extending "moral support" to their so called "brotherly" organization !!
ITGOA is keeping safe distance from this movement as in several occasions earlier. As they are not the strikers, no pay cut or other possible disciplinary action is going to be faced by them.
ITGOA is currently on a nationwide non cooperation for their demands, especially the promotion issue of the  Income Tax Officers for which they will sure look for the support of ITEF in near future because without the active participation of the lower level staff, their agitation will never get any momentum. Let's keep your finger crossed and watch whether ITEF supports their movement despite being isolated on the strike issue.

Return of F.Y. 2011-12 can be filed upto 31.03.2013

Forgot to file your Income Tax return for the F.Y. 2011-12 which was due on 31st July/30th September 2012 ? Don't worry. The return can still be filed. According to Income Tax act , belated return can be filed within 31st March of 2013 without any penalty. If there is any tax still outstanding, you have only to pay interest @ 1% for each month or part of month of delay. In case of no tax payable, there will be no interest. If any tax is outstanding, pay the tax due as Self Assessment Tax alongwith interest payable and then file your return of income within 31st March 2013.
Remember no return of F.Y. 2011-12 can be filed after 31st March 2013. So act fast and live an easy tension free life.

Income Tax Cadre Review : Announcement on 15th February ?

It is learnt from reliable sources that cadre review of Income Tax employees are at the final stage and going to be implemented in near future. 
Meanwhile the promotee officers of the department is on a nationwide agitation which may adversely affect the tax collection in the fag end of the financial year and certainly going to adversely affect the direct tax collection target.
"We have been told that the CBDT board, on the finance minister's instructions, will announce a cadrerestructuring exercise on February 15. However, we do not have any details of this and the contents are deliberately kept under wraps," said another Mumbai-based senior income-tax official.

Tax collection may take a hit as I-T officials announce stir

Even as government has stepped up efforts to mop up tax collection before the fiscal ends, a section of Income Tax officials has decided to shun work and stop issuing assessment orders crucial for recovery of taxes to press their demands, including time-bound promotions. The Income Tax Gazetted  Officers Association (ITGOA), in its latest resolution has said that none of the members will "participate in any search and survey action including TDS survey, inspection, verification, study or whatever name called and recovery surveys from February 20, 2013."
The tax collection work ends by the finish of the current financial year on March 31. The ITGOA includes the second rung of I-T department officials, after the Indian Revenue Service (IRS) cadre which supervises the overall work of revenue collection across the country.
The association, which comprises a substantial chunk of the I-T department workforce, has also decided that they would not cooperate in tax recovery drives and will abstain from submission of statistical reports, dossier reports, demi-official letters from February 11, 2013.
The I-T department is tasked with the collection of revenue under the direct taxes category which includes income tax, corporate tax and wealth tax. The association has demanded implementation of the cadre restructuring proposal, promotions of Income Tax Officers (ITO) to Assistant Commissioners, upgrade in pay scales of a certain rank of officials among other organisation and career progression related issues.
As per latest data, net direct tax collections grew by 12.49 per cent to over Rs. 3.90 lakh crore in the April-January period, less than the budgeted annual target of 15 per cent. The direct tax collection target is 5.70 lakh crore for this fiscal. The tax collection drive could further be hit as yet another association of thedepartment.Income Tax Employees Federation (ITEF)-- is also mulling to join the stir after its all-India meeting on February 11.

Govt to come out with modified DTC Bill

New Delhi, Jan 31 (PTI) The government will come up with a modified Direct Taxes Code (DTC) Bill after incorporating the suggestions of the Standing Committee on Finance, which among things had suggested raising annual income tax exemption limit to Rs 3 lakh.

"Will come out with modified DTC (Bill) in response to Standing Committee suggestions," said Advisor to the Finance Minister Parthasarathi Shome at a FICCI event here.

 The finance ministry is planning to scrap the tax on short-term capital gains arising from the sale of shares and the units of equity-oriented mutual funds.
Top finance ministry officials said a decision on the issue is likely to be taken before next month’s budget.
