CBDT is in dilemma whether to give effect to the CAT, Ahmedabad order received within the DPC meeting first and then issue promotion order or vice versa. The order mentioned here is in favour of an ITO who has to be promoted in the vacancy year 2014-15.

Check any eligibility list
For example eligibilitt list for ACIT
If you find any ITO (sc/st) above you in seniority which was junior to you in Inspector cadre but got promotion earlier due to reservation, that ITO must be your junior in ITO cadre as per catch up rule. He was junior to you in inspector and you will again catch him up in ITO cadre. As per catch up rule, reservation is in promotion, not in seniority.
If anybody file a case of catch up rule, he will win it with ease. It is so simple and judicious.
Neither ITGOA knows or interests nor CBDT in promotional aspects. Forget about ITO to ACIT promotion
The Board is inordinately delaying the promotion of ITO to ACIT wantonly. If it is in the case of IRS people will they maintain the same delay. There must be a law to be implemented in such a way that if a person is not getting his legitimate promotion well in time because of the attitude of the Department like this, the Competent authority must be penalized. If there is problem with one person, why all other people should be suffered for the sake of a single person?. Baring one post exclusively for that affected person, all other persons must be promoted. Because of this, all the consequential lower grade promotions are also affected. IGOA & ITEF generally the JCA please take up this matter and get the promotion of ACIT within a day or two

Even if the cbdt pass the adhoc acit order, our great pccit of tamilnadu wont pass consequent order by giving his own version for the same. Itgoa or itef wont take this issue with board and they simply keep silent. Even for 2014-15 vacancy the jca not able to get clarification from the board which was sent by the pccit tamilnadu. God please bless the leaders.
Competent authority can be panalised for delay but itgoa leadership should show some courage and file case against individual for not following dopt calender
But they spread hands before competent authority for cream posting and defeat 97% before rule breaker
Adhoc promotion can be done if there are obstructions like Court cases so it is strange that cbdt dont hesitate withheld legitimate promotion like british era
But ITGOA leadership is responsible for that not cbdt
For the sake of benefiting one person from Gujarat, who is not retiring any way, the CBDT has not promoted an eligible person before his retirement. If this happens to any IRS, will they keep quiet. What ITGOA is doing.......

Catch up rule, has it been applied in any case in reality?
Catch up judgment by apex court is new so many people doesnt know about it. It has been applied in cases who faught for this

On the basis of NR Parmar, DRITI failed not only before the CAT Alld bench (OA 330/2016) but also before Pr.CAT (OA No.1994/2016) to obtain stay on DPC for ITO in UP(W)
This uncertainty has been literally caused due to NRP.
Allowing seniority for the period they played in ground, pursued prosspects of other careers, studied in universities etc is unjust morally.
This is because of the corrupt and selfish leaders in itgoa. The whole association in now a stinking gutter
