In a letter to Chairperson, CBDT, JCA desired intervention of her regarding calculation of vacancy. As per the letter, DGIT, HRD tried to convince JCA leadership to accept an arbitrary figure for the promotion in the cadre of ACIT.
They also complained that DGIT had taken a totally different stand regarding the previously agreed principle adopted by his own office.
JCA sought immediate intervention of the Chairperson to resolve the issue.
The letter mentioned the following enclosure but the calculation of vacancy by DGIT(HRD) was not made public for reasons best known to them.

Please implement RAJEEV MOHAN and CATCH UP RULE judgements of SUPREME Court before conducting any further for ITO to ACIT. DO NOT become illegitimate sibling of N R PARMAR.
Real benefit of catch up is only if it get implemented before ITO TO ACIT promotion, give representation to CBDT immediately
Bring some unbiased IAS officers to CBDT HRD wing instead of partisan IRS Officers who are making hurdle in every day for the promotee and non gazetted officers.

Every on knows that RAJEEV MOHAN is an opposite and contradictory judgement of NRP. Only one can be implemented. NRP implementation is almost in final stage. From reliable information, it is reveals that some people not belongs to OUR DEPTT are mis leading the readers of this blog. Most of the readers and commentator comments misleading information to confuse the employees of the INCOME TAX DEPTT. some of the people are CENTRAL EXCISE, ED and others deptt. Catch up rule is very old one and can not be implemented for CENTRAL GOVT EMPLOYEES. Koi aur rule hai to bolo bhai.
Supreme Court decision is to be implemented in all departments. If NRP judgement relates to gujarat region seniority then how it is implemented in the entire I.t. dept.
Both have to be implemented along with catch up rule. There is no alternative otherwise litigation will continue and promote IRS will retire as DCs only.

Friends let us encourage our JCA leaders to fight for our all demands. Any grievance we can approach through our unions. If we argue ourselves like these no one can become even DCs.
Sc/st candidate should support catch up rule. They should not make mistake like Brahmins did in ancient India. Birth right privilege in not beneficial to indian society especially in promotion. After serving in department for years you are not a deprived community

IRS are thinking that entire Income Tax Department is their inherited property. Hence, they are not in favour of giving any promotion. Recent development of publishing the seniority list is nothing but a carrot shown to ITOs and a trap to incerease litigations . CATCH UP RULE IS NOW OFFICIALLY RECOGNISED LAW OF THE LAND. Direct ITIs should not be jealous as promotes allowed implementation if N R PARMAR so also CATCH RULE FORMULATED BY HONOURABLE SUPREME COURT SHOULD BE IMMEDIATELY IMPLEMENTED BY HRD DOPT CBDT THROUGH AN ADVISORY BY GIVING RETROSPECTIVE EFFECT FROM WHEN N R PARMAR IS IMPLEMENTED. direct ITIs should not gave to worry as they will retire as DCs I. JCA should not agree for less than 400 ACIT posts or clearing entire 2001 batch of ITOs so that waiting of morethan 14 years will end.
In 2001 CR IAS were in charge of then AD-VI now renamed as HRD and all in the department got their due share of promotions whereas in 2013 CR, IRS are in the helm of affairs and protecting the interest of the IRS only. So JCA should demand IAS to be posted in HRD again to have a balanced decision.
Rajiv Mohan is a DRI and in favour of NRP. He was intercharge trasferee and got seniority frm the date of joining in new region. There is dispute of seniority between DRI inspectors only not between DRI and PRI. He got seniority above the DRI who joined later because he was adjusted against the DRI quota of the same year. 10-40, A.M. has said a bitter truth, the all the mess in promotion of ITOs is created by HRD, when the establishment was headed by IAS officers there were no discrimination, than IRS has conspired to capture the HRD, and start making harm to career prospects of promotee officers. Mr 11.27 read the 1986 OMs again and again and again if not understood then go to TAX ASSISTANT OF 2012 batch he will better explains you. In 1986 OMs it is clearly mentioned that the people join via inter charge will be placed below all DR and PR join against the same vacancy year irrespective of data of joining of the ICT. Rajiv Mohan pronounced that the ICT will be given seniority from the date of joining even before the joining of DR and PR. FROM the above facts and circumstances it is concluded that both the judgement are contradictory. Only one can be implemented. Since NRP implementation is in final stage so Rajiv Mohan can not be implemented like various judgements pronounced by the Hon Supreme Court. so friends never distribute sweets.
DG(HRD) is not a competent person. He is unable to give unanimous direction. For example consequential vacancy arose from the promotion of ITO to ACIT for the year 2013-14 actually arose in vacancy year 2014-15 but Mumbai and Pune region cosidered it the V.Y. 2013-14 and all other reason considered it in V.Y. 2014-15. You think that you are wiser than Supreme Court thats why you joined this department as TA/LDC/PEON. Rajive mohan contesed for seniority within Direct Recruited inspectors. If seniority of DRIs get settled then seniority of DRI and PRI will be the next step. No court would like to deliver contradicting judgments. Facts are different in both cases. If you dont think so, apply in CAT, you will also find them fool thats why you entered in this department as TA/UDC/LDC
If the DGIT HRD's proposal been accepted, then no promotee in future will go beyond DCIT cadre especially the recently recruited ITIs.
vigilance clearance is being sought by 18.09.2015 for around 180 vacancies for promotion to ACIT.
