CBDT came out with clarification on Parmar issue, at last

CBDT issued clarification on Parmar issue at last. The letter dated 06.06.2013 is linked under for everybody. As per the letter the operative part is as under :
"In the specific context of Income Tax Dept., wherein the inter se sinority of direct recruit and promotees have been under dispute on the grounds of misinterpretation of the provisions of O.M. dated 7.2.86/3.7.86 and has led to Parmar judgement of Supreme Court, it is unambiguously confirmed that the entire issue of seniority of officers of  Income Tax Dept. would have to be revisited in compliance of the judgement of the Supreme Court."

Respected followers of this Blog...Now after plethora of litigation and contineous fight by the fighters CBDT has been compelled to issue the DOPT clarification dated 01.05.14 after 37 days...But still some PR CCIT may have doubt and may sought clarification on this too....Jai Ho....Truth Won...

nuisance of DRs to DOLA.

May God give good sense to Mumbai Pr.CCIT . Now even after this fresh guidelines issued by CBDT he may try to read between the lines and may deny the legitimate rights of promotee. Most erudite among his colleagues.

nless ITEF initiates quick step by approaching the Board to fill all the vaccant posts by giving one time relaxation, many staff will suffer in the yoke of Parmar case. Hence, our ITEF leaders should focus on this issue seriously. This is the crucial time, ITEF should work for the benefits of all the existing staffs. All are requested to comment on this issue please. We are always with ITEF.

The individual CCAs were interpreting things as per their whims and fancies.
They defied Apex Court verdict\ CBDT\ DoPT guidelines.
Now MoF is directly instructing CCAs. Where does the CBDt stand?
Indiscipline at its worst. No wonder people attend office for two days a month and sign for the whole month.

What about intercharge transferres?
Anybody is going court?
The application for intercharge was not forwarded because of no completion of 3years. If we take the seniority as per palmar case definitely the the persons who came from intercharge will be benefited.

Jai Ho!! Now the Hon. Principle CCIT should answer this question that under which OM the seniority of erstwhile direct recruit UDC's are fixed? and if their seniority is not fixed as per OM of 86 then don't hesitate now and fixed them as per 86 OM.

After all promotions DRs managed to bring out the circular in their favour. DRs were late in making the payment it seems !!! O la la

DoPT says that NR Parmar order should be implemented only from 27.11.2012. Now CBDT says that previous seniority also should be revisited. Isn't CBDT "clarification" in violation of DoPT order ? Like 3.3.2008 clarification, even this CBDT order will be struck down. No doubt.

At last, it gives a hope that the CBDT and the DOPT have realised the right path. But I only wonder why they can't issue an order without any ambiguity. It defenitely cannot be that they are not able to draft a clear order. Even now there are room for mis-interpretation. It reminds me of the saying "The present rule is vague and confusing, but far better than the earlier one which was wrong and misleading." It is high time that the CBDT come out with the deadline date for the CCAs to revise the seniority of ITOs based on NRP and then consolidate the same and publish the All India Seniority list of ITOs to ensure transparency. Will they have the WILL to do it?

Who is going to decide whether OM 1986 was misinterpreted? Is it DR UDC or PR.CCIT or CAT? In MUMBAI Some DR UDCs are going to accept promotion of IITs on old seniority & after getting the promotion they woke up for OM1986. Is it not a double stand?
